RECOMMENDATION(S)

Recommendation

1.                     Approve non-financial Memorandum of Understanding with the Marine Corps Logistics Base, Barstow, California to establish procedures for coordinating the reporting and investigating of suspected child abuse and neglect referrals involving Marine Corps Logistics Base, Barstow, California personnel and families effective upon execution through March 30, 2025.

2.                     Designate the Assistant Executive Officer of Human Services, the Deputy Executive Officer of Human Services, or the Director of Children and Family Services as authorized to execute any subsequent non-substantive amendments necessary to the Memorandum of Understanding with the Marine Corps Logistics Base, Barstow, California on behalf of the County, subject to review by County Counsel.

3.                     Direct the Assistant Executive Officer of Human Services, the Deputy Executive Officer of Human Services, or the Director of Children and Family Services to transmit all amendments in relation to this Memorandum of Understanding to the Clerk of the Board of Supervisors within 30 days of execution.

FINANCIAL IMPACT

The Memorandum of Understanding (MOU) with the Marine Corps Logistics Base, Barstow California (MCLB) is non-financial; therefore, it does not impact Discretionary General Funding (Net County Cost).

 

BACKGROUND INFORMATION

The Commanding Officer at MCLB is responsible for the protection of abused and/or neglected children of MCLB personnel and families stationed.  Due to judicial restrictions, MCLB personnel are unable to remove children from possible harmful family situations, provide necessary intervention services, and/or adjudicate cases.  The State of California, through Children and Family Services (CFS), and under the authority granted by the Child Abuse and Neglect Reporting Act and the Welfare and Institutions Code, is responsible for the protection of abused/neglected children in San Bernardino County.

 

On March 3, 2015 (Item No. 23), the Board of Supervisors (Board) approved a non-financial MOU with MCLB (County Agreement No. 15-119) establishing procedures for dealing with children at risk of abuse and/or neglect and whose families are stationed on the military installation for the period of March 4, 2015 through March 30, 2020.  The MOU established written procedures to coordinate CFS and MCLB authorities and activities involving alleged abuse and/or neglect of children of military families.  The MOU did not purport to expand, limit, or modify either party’s jurisdiction.  It was intended to be an operational understanding of existing duties and methods of operation and cooperative procedures by both parties.

 

This new MOU will ensure the coordination of authorities, activities, and operational understanding between CFS and MCLB continues without interruption.  This item also requests approval for the Assistant Executive Officer of Human Services, the Deputy Executive Officer of Human Services, or the Director of CFS to approve any subsequent non-substantive amendments to the MOU, on behalf of the County, subject to review by County Counsel.  CFS will present all other amendments to the Board for approval.
