Approve Amendment No. 2 to Contract No. 23-477 with Michael Baker International for professional engineering design services associated with the Lake Gregory Regional Park Sitewide Sediment Management Project, increasing the total approved contract amount by $29,990, from $487,140 to $517,130, with no change to the contract term of May 23, 2023, through December 31, 2026.

FINANCIAL IMPACT
Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). Reimbursement of eligible expenditures for the Lake Gregory Regional Park Sitewide Sediment Project (Project) was funded through an allocation of $1,765,000 from the County’s American Rescue Plan Act (ARPA) Coronavirus Local Fiscal Recovery Fund (CLFRF) for eligible costs and a one-time Discretionary General Funding allocation for the Project of $3,235,000. The total combined allocation for the Project is $5,000,000.
Sufficient appropriation for the Project, including the proposed amendment, is included in the Department of Public Works - Special Districts’ (Department) County Service Area (CSA) 70 - Countywide Capital Improvement Project’s (CIP) 2024-25 budget and will be included in future recommended budgets as needed.
BACKGROUND INFORMATION
The Department provides design, construction, operations and maintenance support services to Regional Parks, which includes Lake Gregory. The Project consists of the removal of accumulated sediment at Lake Gregory. Additional sediment and debris were deposited in the lake during the 2020, 2021, and 2022 storm seasons. Removal of accumulated sediments will improve the health of the lake as well as the recreational use of this amenity. The Project is a priority to effectively manage lake sediments and long-term maintenance of Lake Gregory.
On May 23, 2023 (Item No. 67), the Board of Supervisors (Board) approved Contract No. 23-477 (Contract) with Michael Baker International (MBI) for professional engineering and environmental services for the Project, such as (1) swim beach accessibility; (2) sediment management; (3) environmental clearance and mitigation, (4) lake surveying and bathymetric mapping; and (5) bidding and construction support services, in the amount of $463,204, for the term of May 23, 2023 through December 31, 2026.
On August 20, 2024 (Item No. 65), the Board approved Amendment No. 1 to the Contract for additional engineering design review support, Administrative Draft California Environmental Quality Act documentation, and pre-application jurisdictional wetland/waters permit support required for the Project beyond the level of support identified in the original scope of work, for an additional $23,936, for a new total contract amount of $487,140, with no change to the term.
The proposed Amendment No. 2 includes additional required environmental support services for regulatory permitting with U.S. Army Corps of Engineers, Regional Water Quality Control Board, and California Department of Fish and Wildlife beyond the level of support identified in the current scope of work. This additional support is needed due to agency requirements to reassess temporary and permanent project impacts and engage in additional coordination meetings with the regulatory agencies to establish an acceptable resolution and permitting pathway. for an additional amount of $29,990, for an updated total contract amount of $517,130, with no change to the term.
