Recommendation

Acting as the governing body of County Service Area 53 B Fawnskin, approve Amendment No. 3 to Agreement No. 11-610 between the Big Bear Area Regional Wastewater Agency, City of Big Bear Lake, Big Bear City Community Services District, and Zone B of County Service Area 53 Fawnskin, for the treatment and disposal of County Service Area 53 B wastewater, extending the term by five years, for a total term of July 1, 2011 to June 30, 2031, with no change to the cost provisions based on wastewater flows plus actual costs.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). Annual payments to the Big Bear Area Regional Wastewater Agency (BBARWA) for the treatment and disposal of County Service Area (CSA) 53 B - Fawnskin (District) wastewater are funded through service charges and user fees collected within the District. The current estimated annual cost is approximately $541,737. For reference, this equates to approximately $427 per equivalent dwelling unit (EDU). An EDU is a unit of measure used to estimate wastewater generation from a residential or commercial property. Actual annual payments will continue to vary based on BBARWA’s adopted budget and wastewater flow from the District. Costs associated with this agreement are included in the District’s 2025-26 budget and will be included in future recommended budgets as appropriate.

 

BACKGROUND INFORMATION

On August 23, 2011 (Item No. 80), the Board of Supervisors (Board) approved Agreement No. 11-610 (Agreement) whereby San Bernardino County, through the District, entered into an agreement with the BBARWA, the City of Big Bear Lake, and the Big Bear City Community Services District to establish a framework for the payment and collection of wastewater-related charges. These charges include the Total Annual Charge, Service Charge, Infiltration/Inflow Charge, and Standby Charge. The Agreement outlines the responsibilities of each party in collecting and remitting these charges to BBARWA to support the operation and maintenance of the regional wastewater system serving the Big Bear Valley. The Agreement term was July 1, 2011, through June 30, 2016.

 

On April 19, 2016 (Item No. 77), the Board approved Amendment No. 1 to the Agreement, extending the term by five years through June 30, 2021. On May 18, 2021 (Item No. 87), the Board approved Amendment No. 2 to the Agreement extending the term five additional years from July 1, 2021 to June 30, 2026.

 

Pursuant to Sections 3.6 and 3.11 of the Agreement, the parties may amend the Agreement by mutual consent. Amendment No. 3 extends the term of the Agreement through June 30, 2031, ensuring continued coordination and financial support for wastewater services in the region. All other terms and conditions of the Agreement remain unchanged.
