Recommendation
Acting as the governing body of the San Bernardino County Fire Protection District, approve Amendment No. 7, retroactively effective on July 1, 2022, to Revenue Agreement No. 18-354 with the Fontana Fire Protection District, increasing the annual amount by $2,536,425, from $37,436,725 to $39,973,150, for fiscal year 2022-23 to compensate San Bernardino County Fire Protection District for its costs of providing fire protection and emergency medical services to the Fontana Fire Protection District, as well as amending the Financial Review Section, with all other contract terms remaining in effect until June 30, 2038.

FINANCIAL IMPACT
Approval of this amendment will not result in the use of additional Discretionary General Funding (Net County Cost) as this is a revenue contract. The Fontana Fire Protection District (District) is compensating San Bernardino County Fire Protection District (SBCFPD) for the cost of providing service in accordance with the terms of Agreement No. 18-354 (Agreement). The increase in annual compensation to SBCFPD from this amendment is $2,536,425. Revenue for this agreement is included in SBCFPD’s 2022-23 budget.
BACKGROUND INFORMATION
On June 26, 2018 (Item No. 80), the Board of Directors (Board) approved the Agreement allowing SBCFPD to provide fire protection and emergency medical services to the District. The term of the Agreement is for 20 years, ending on June 30, 2038. The compensation amount for providing services is adjusted annually based on various factors and in accordance with Section 3.B of the Agreement.
To date, the Agreement has been amended six times. The Board approved the most recent amendment (Amendment No. 6) on June 22, 2021 (Item No. 113), which increased SBCFPD’s compensation amount to $37,436,725 for 2021-22.
Approval of Amendment No. 7 will increase the Agreement’s annual amount by $2,536,425, from $37,436,725 to $39,973,150, for SBCFPD’s additional costs of providing service to the District. The additional costs include the addition of one new Captain position approved in the 2022-23 budget, as well as increased salary and benefit expenses from negotiated MOUs with the labor unions. Amendment No. 7 also amends the Financial Review Section to change the month (from March to April) that the proposed contract cost for the following fiscal year is provided by SBCFPD to the District.
Amendment No. 7 is retroactive to July 1, 2022, due to a delay in contract costing. SBCFPD had numerous MOU increases for various labor organizations that were presented to the Board in the past few months. As a result, costing was delayed in order to incorporate these changes into the amended contract amount. All other terms of the Agreement shall remain the same.
