Recommendation
Acting as the governing body of County Service Area 70 R-39 (Highland Estates), approve a $97,500 increase to the 2021-22 budget for road repairs and authorize the Auditor-Controller/Treasurer/Tax Collector to post the budget adjustment as detailed in the Financial Impact Section (Four votes required).

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost) as the road repairs will be funded entirely by available reserves of County Service Area 70 R-39 (CSA 70 R-39). Proceeding with the repairs does require the following budget adjustment for CSA 70 R-39:

Appropriation for the road repairs was approved in the 2020-21 Second Quarter Budget Report (March 23, 2021 - Item No. 82). The project was expected to be completed by fiscal year-end and therefore was not included in the 2021-22 budget. However, the project was inadvertently delayed and is now ready to commence.
BACKGROUND INFORMATION
On December 19, 2000 (Item No. 96), the Board of Supervisors approved the formation of CSA 70 R-39 in the Oak Hills/Phelan area for the pavement and maintenance of approximately 3.3 miles of road. CSA 70 R-39 is funded by an annual service charge of $405 per parcel.
Due to normal seasonal degradation and damage that occurs to pavement, the roads within CSA 70 R-39 require periodic and routine maintenance to include occasional pavement rehabilitation for safe operational performance levels.
Approval of this recommendation will allow sufficient appropriation for a road repair project of $97,500. The existing roadway will have approximately 300 longitudinal cracks grounded down and filled with asphalt to return the roadway to a safe maintainable condition.
Due to multiple projects that were concurrently in progress, it was determined through a prioritization process based on need and severity to delay the project until fiscal year 2021/22, resulting in the recommended request to increase the 2021-22 budget.
PROCUREMENT
The contractor for this project will be Bacon Wager Excavating, Inc. (BWE). BWE is one of four contractors approved by the Board of Supervisors (Board) on June 26, 2018 (Item No. 89) to provide pavement maintenance and repair services, as needed, for the Board-Governed County Services Areas through June 30, 2023.
