RECOMMENDATION(S)
Recommendation
1. Acting as the governing body of San Bernardino County:
a. Find that the Interstate 10 Corridor Freight and Express Lanes Project being constructed by the San Bernardino County Transportation Authority serves a general San Bernardino County public purpose.
b. Authorize the payment of $35,000 to the San Bernardino County Flood Control District to cover review and inspection fees associated with the construction permit for the Interstate 10 Corridor Freight and Express Lanes Project.
c. Authorize the Auditor-Controller/Treasurer/Tax Collector to post the budget adjustments as detailed in the Financial Impact section (Four votes required).
2. Acting as the governing body of San Bernardino County Flood Control District:
a. Authorize the receipt of payment in the amount of $35,000 from San Bernardino County for the review and inspection fees associated with the construction permit for the Interstate 10 Corridor Freight and Express Lanes Project.
b. Authorize the Auditor-Controller/Treasurer/Tax Collector to post the budget adjustments as detailed in the Financial Impact section (Four votes required).

FINANCIAL IMPACT
Approval of this item will result in the use of additional Discretionary General Funding (Net County Cost). The San Bernardino County Flood Control District (District) review and inspection fees associated with construction permit FCCON-2024-00021 (Permit) are estimated to be $60,000. These fees are typically paid by the applicant pursuant to District Fee Ordinance FCD No. 24-01. In this instance, the San Bernardino County Transportation Authority (SBCTA) Interstate 10 Corridor Freight and Express Lanes Project (Project) also serves a general San Bernardino County (County) public purpose.
On an annual basis, the County allocates $25,000 in Ongoing Discretionary General Funding to the District for General Purpose projects. Of the total $60,000, $25,000 will be covered by the County’s annual discretionary allocation for general purpose projects, which is already budgeted. The remaining $35,000 is being requested as additional one-time of Discretionary General Funding for 2024-25 in order to cover SBCTA’s review and inspection fees of $60,000 for the Project (1910002518 - FCCON2400021).

BACKGROUND INFORMATION
The District issued the Permit to SBCTA for the Project for work along Day Creek Channel, San Sevaine Channel, and Mulberry Channel, including bridge widening, bridge reconstruction, removal of portions of existing flood wall, and flood wall replacement. SBCTA submitted a request for a no-fee permit for this Project.
The benefits of this Project will improve traffic flow, reduce commute times for San Bernardino County residents, and bolster emergency vehicle access and response capabilities. By alleviating congestion and enhancing safety measures, the quality of life should improve for San Bernardino County residents. Furthermore, the provision of shoulders will greatly enhance emergency response times and ensure prompt assistance during critical situations.
The San Bernardino County Board of Supervisors may choose to pay the fees on behalf of SBCTA if it determines that the Project serves a benefit to the public. In accordance with County procedures, the District is requesting additional one-time County Discretionary General Funding to cover the review and inspection fees for the Permit, which are estimated to be $60,000.
