RECOMMENDATION(S)
Recommendation
1. Find that approval of Amendment No. 3 to Revenue Lease Agreement No. 06-1122 with Cement Masons Joint Apprenticeship Trust for land is an exempt project under the California Environmental Quality Act Guidelines, Section 15301 - Existing Facilities (Class 1).
2. Find that approval of Amendment No. 3 to Revenue Lease Agreement No. 06-1122 with Cement Masons Joint Apprenticeship Trust for land serves a public purpose by meeting the social, law enforcement, and public safety needs of the County pursuant to California Government Code Section 26227.
3. Approve Amendment No. 3 to Revenue Lease Agreement No. 06-1122 with Cement Masons Joint Apprenticeship Trust to:
a. Extend the term of the lease for an additional five years, commencing April 1, 2026 and continuing to March 31, 2031, following a permitted holdover period from November 7, 2012 through March 31, 2026.
b. Provide two additional five-year options to extend the term under the same terms and conditions.
c. Authorize the continued, non-exclusive use of approximately one acre of County-owned land at the Sheriff/Coroner/Public Administrator’s Regional Training Center in Glen Helen, located at 18000 Institution Road, San Bernardino.
d. Allow in-kind services to be provided to the Sheriff/Coroner/Public Administrator in lieu of monetary rent.
4. Direct the Real Estate Services Department to file the Notice of Exemption in accordance with the California Environmental Quality Act.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). No monetary revenue is associated with Amendment No. 3 (Amendment) to Revenue Lease Agreement No. 06-1122 (Lease). The Cement Masons Joint Apprenticeship Trust (CMJAT) will continue to provide services for site improvement projects approved by the Sheriff/Coroner/Public Administrator (Sheriff) at the Sheriff’s Regional Training Center (SRTC) as in-kind services in lieu of monetary rent. The estimated value of CMJAT’s in-kind services during the term of this Amendment is approximately $525,000, which exceeds the estimated fair market value rent of $418,200 for the land over the five-year term. The County will provide electricity, recycled and potable water, and trash and sewer services, which are included in the Sheriff’s operating budget (4430001000).
BACKGROUND INFORMATION
The recommended action will amend the Lease with CMJAT to extend the term for five years, for the period of April 1, 2026 through March 31, 2031, for the non-exclusive use of land at the SRTC in Glen Helen because of the continuing need to improve the training facilities at the SRTC.
On November 21, 2006 (Item No. 37), the Board of Supervisors (Board) approved a Lease with the CMJAT to relocate its apprenticeship training program to the SRTC in the unincorporated area of Glen Helen. The Lease provided for CMJAT’s use of approximately one acre of County-owned land and access to one County-owned classroom at SRTC. The original lease term was for the period of November 7, 2006 through November 6, 2008. Since the Lease was originally approved, the Board has approved two amendments extending the term through November 6, 2012, adding additional site improvement projects, and updating standard lease agreement language.

In lieu of monetary rent, CMJAT apprentices have provided in-kind services that directly benefit County operations by completing site improvement projects at the SRTC. These services have included installing and maintaining cement curbs and gutters, constructing diversion channels to reroute floodwater, and building walkways to provide handicap access to classrooms and other facilities. These projects have enhanced the functionality and safety of the training center while providing hands-on training opportunities for CMJAT apprentices, resulting in significant improvements to County facilities at no cost to the County.
The lease entered a permitted month-to-month holdover beginning November 7, 2012, due to timing associated with protracted negotiations and administrative processing. Continued occupancy was necessary to avoid disruption of critical In-Kind services CMJAT provides to Sheriff in San Bernardino. The holdover period was at the same rental rate and terms as the prior lease period.
Approval of this Amendment is recommended to extend the term for an additional five years, from April 1, 2026 through March 31, 2031. The proposed five-year term follows a permitted 13-year holdover period due to the County’s protracted negotiations with the CMJAT to renew the lease, during which the tenant continued to provide in-kind services consistent with the Lease’s intent and benefit to County operations. At the request of the Sheriff, the Real Estate Services Department (RESD) has prepared this Amendment to support ongoing facility improvements. During the extended term, CMJAT will undertake a range of projects, including installing and maintaining curbs and gutters, constructing wheelchair ramps at classroom entrances, building walkways connecting tracks and obstacles on the physical training field, and installing concrete drill pads in the quad area of the administrative building.
The Amendment approval was reviewed in accordance with the California Environmental Quality Act (CEQA) and determined to be categorically exempt under CEQA Guidelines Section 15301 - Existing Facilities (Class 1), as the Lease does not have the potential to result in a significant environmental impact.
