Recommendation
Approve Amendment No. 1, effective July 15, 2020, for the non-financial contract with Battelle Memorial Institute (Battelle), to include transportation coordination services of the N95 respirator masks sent for decontamination and re-use, for a total contract period of April 23, 2020, through April 23, 2021, with no other changes to the contract terms or conditions.

FINANCIAL IMPACT
Approval of this item with Battelle Memorial Institute (Battelle) for N95 respirator mask decontamination transportation and logistical coordination will not result in the use of Discretionary General Funding (Net County Cost). The amendment to include transportation coordination as part of the contract terms is non-financial.
BACKGROUND INFORMATION
On March 12, 2020, the World Health Organization declared COVID-19 a pandemic. On March 13, 2020, the President of the United States declared a National Emergency concerning the Novel Coronavirus Disease (COVID-19) Outbreak. To provide for the safety, health and social needs of the community, especially those in critical care and/or identified with COVID-19 symptoms, Arrowhead Regional Medical Center (ARMC) required N95 respirator masks. N95 respirator masks were in short supply thus requiring a back-up plan that allowed for the decontamination and re-use of N95 respiration masks.
On April 10, 2020, Battelle entered into a contract with Defense Logistics Agency (DLA) under which Battelle will operate the Critical Care Decontamination SystemTM (CCDSTM) to process N-95 or N-95-equivalent respirators for healthcare personnel qualifying under the Emergency Authorization Act issued by the Food and Drug Administration on March 28, 2020. Under the operations agreement between Battelle and DLA, the costs of processing N-95 for N-95-equivalent respirators will be assumed by FEMA and/or HHS, and thus no costs will be charged to qualifying healthcare personnel, including ARMC.
On April 23, 2020, the County’s Chief Executive Officer signed a Master Service Agreement with Battelle for N95 Mask Decontamination services on behalf of the County of San Bernardino for Arrowhead Regional Medical Center based upon the authority delegated to him by the Board of Supervisors (Board) on March 24, 2020 (Item No. 6). This was ratified by the Board on May 5, 2020 (Item No. 4).
Beginning April 10, 2020, Battelle began providing logistical coordination support to customers due to the limited transportation available to vendors and the urgent need to transport contaminated masks. This amendment clarifies that, as part of the Master Service Agreement, Battelle may provide such support services at ARMC’s request.
PROCUREMENT
Procurement of Battelle Memorial Institute services is a non-competitive, one-year contract, based on specialized credentials as it is the sole-vendor approved by the FDA under the Emergency Use Authorization to provide decontamination services that allow N95 masks to be reused up to 20 times. Purchasing concurs with the non-competitive justifications specialized credentials and functionalities. Amendment No. 1 represents a one-year contract with no changes to the contract terms, conditions or dates of service.
