Recommendation
1. Approve Amendment No. 1 to Contract No. 24-943 (State of California Participating Addendum Number 7-23-70-55-01), effective June 30, 2025, which includes Amendment Nos. 1 and 2, to the Minnesota National Association of State Procurement Officers ValuePoint Master Agreement Number 23026 with Dell Marketing L.P., for the procurement of Dell Computer equipment, updating the participation term until expiration or termination by either the State of California or San Bernardino County through the renewal term limit of June 30, 2028.
2. Authorize the Purchasing Agent to execute any documents that may be required by the State to execute orders against State of California Participating Addendum Number 7-23-70-55-01, subject to County Counsel review.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). Participating in the National Association of State Procurement Officers (NASPO) with California Participating Addendum Number 7-23-70-55-01 (California PA) allows the County to purchase Dell products at a reduced cost for government entities. If future purchases are made under the California PA, the Probation Department (Probation) will adhere to County purchasing policies and return to the Board of Supervisors (Board) for approval, if necessary.
BACKGROUND INFORMATION
Dell is an information technology solutions provider, selling to federal, state and local government agencies, as well as education and healthcare markets. After conducting a competitive bidding process, the State of Minnesota awarded Dell Marketing L.P. (Dell) the contract for the purchase of computer equipment and peripherals. The State of Minnesota has made this contract available for use by other government entities through the NASPO cooperative purchasing program that facilitates public procurement solicitation and agreements using a lead state model. The Minnesota NASPO agreement is identified as ValuePoint Master Agreement Number 23026. Under this agreement, the State of California (State) signed the California PA, allowing State agencies and local government entities to make purchases under the NASPO agreement.
On December 5, 2023 (Item No. 39), the Board approved Contract No. 24-942 (an addendum to the Minnesota NASPO agreement), allowing the County to participate in the California PA and procure Dell products directly from Dell through the NASPO agreement as it was more cost effective compared to vendors that were awarded Countywide contracts. This contract terminated January 31, 2024, and a new contract, the California PA, was established effective from February 1, 2024 to June 30, 2025, with a renewal limit until June 30, 2028.
On September 24, 2024 (Item No. 44), the Board approved Contract No. 24-943, an addendum to Minnesota NASPO ValuePoint Agreement Number 23026 with Dell, for computer equipment, for a term of September 25, 2024 through June 30, 2025.
Subsequently, on October 25, 2024, the State executed Amendment No. 1 to the California PA, which added a section for Generative Artificial Intelligence Reporting. On May 15, 2025, it executed Amendment No. 2 to the California PA, extending the term to June 30, 2026. This item includes an amendment to the Board approved participation that reflects Amendments 1 and 2 to the California PA.
Probation recommends approval of the amendment to continue Probation’s participation in the California PA through the updated period of June 30, 2025 until the expiration or termination of the California PA by either the State or the County until the renewal term limit under the NASPO Agreement of June 30, 2028. If the State continues to extend the term limits, the requested approval will reduce future duplicative requests to continue extending the participation term for the same agreement in future items. If the State enters into additional addendums that require the County to adhere to non-standard terms, Probation will return to the Board for approval of the updated terms. Probation seeks a retroactive renewal date of June 30, 2025, to align with the State’s renewal date. Approval of this amendment will enable Probation to use County funds effectively by obtaining Dell computer equipment at a competitive cost.
