Recommendation
Acting as the governing body of the San Bernardino County Fire Protection District, approve Amendment No. 1 to Revenue Agreement No. 20-655 with Corporate E-Waste Solutions for electronic waste disposition services at established rates, extending the term for a two-year period, for a total contract term of September 14, 2020, through June 30, 2027.

FINANCIAL IMPACT
Approval of Amendment No. 1 (Amendment) will not result in the use of Discretionary General Funding (Net County Cost) as this is a revenue contract.
In accordance with Revenue Agreement No. 20-655 (Agreement), Corporate E-Waste Solutions (CEWS) will reimburse and charge San Bernardino County Fire Protection District (SBCFPD) for the provision of electronic waste (E-Waste) disposition services at the rates displayed in the following table:

The total estimated reimbursement amount to SBCFPD for the extended contract period is $80,000. Total estimated costs to SBCFPD during this term shall not exceed $4,000 per Section F.3 of the Agreement. Therefore, the estimated net reimbursement amount to SBCFPD is $76,000.
Sufficient appropriation and revenue for this Amendment are included in SBCFPD’s 2025-26 budget and will be included 2026-27 recommended budget.
BACKGROUND INFORMATION
SBCFPD’s Household Hazardous Waste (HHW) Collection Program was implemented by the County in 1984 and provides for the collection and management of HHW, including used motor oil and oil filters, E-Waste - such as cathode ray tubes and other electronics, universal waste (such as fluorescent tubes and household batteries), pesticides, herbicides, and pharmaceuticals (excluding controlled substances). All HHW, except for E-Waste, is packaged by HHW staff using Federal Department of Transportation approved containers and prepared for transportation to recycling/disposal facilities located outside California.
SBCFPD does not have the capability for recycling E-Waste. On August 11, 2020 (Item No. 50), the Board of Directors (Board) approved the Agreement with CEWS for CEWS to provide E-Waste disposition services for the period of September 14, 2020, through June 30, 2025. This Agreement allows for CEWS to perform all required services relative to collecting, transporting, storing, disposing, and recycling of E-Waste collected by the SBCFPD’s HHW Collection Program.
Approval of Amendment No. 1 to the Agreement extends the term for an additional two years, continuing through June 30, 2027, and updates the mailing address information for SBCFPD due to the relocation of its headquarters. All other terms of the Agreement remain the same.
CEWS was selected as the current contractor for E-Waste disposition services after a competitive Request for Proposal (RFP) process in 2020.
The amendment extends the CEWS contract as a non-competitive procurement to ensure there is no lapse in E-Waste collection services and allows SBCFPD to continue with this vendor while proceeding with a new RFP for E-Waste collection services. This amendment will ensure that the County remains in compliance with E-Waste disposal regulations. A two-year extension to the Agreement is recommended to complete the RFP process, and award a new service contract, which is to be approved prior to expiration of Amendment No. 1. The Purchasing Department concurs with the non-competitive justification for this amendment.
