Recommendation

Approve Amendment No. 2 to contracts with the following agencies to provide National Curriculum and Training Services and Enrichment Services to Probation Youth, extending the contract period by one year, for a total contract period of July 1, 2021 through June 30, 2026, with no change to the aggregate not to exceed amount of $6,000,000:

1.                     California Association of Health and Education Linked Professions, Contract No. 21-478.

2.                     Empowering Success Now, Contract No. 21-480.

3.                     Inland Valley Recovery Services, Contract No. 21-482.

4.                     Lutheran Social Services of Southern California, Contract No. 21-483.

FINANCIAL IMPACT

This item does not impact Discretionary General Funding (Net County Cost). The total cost of the National Curriculum and Training Institute (NCTI) and Enrichment Services contracts will not exceed the aggregate amount of $6,000,000 for the five-year period of July 1, 2021 through June 30, 2026. The contracts are funded entirely through the Juvenile Justice Crime Prevention Act Fund. Adequate appropriation and revenue have been included in the Probation Department’s (Probation) 2024-25 budget and will be included in the 2025-26 recommended budget.

 

BACKGROUND INFORMATION

Probation has contracted for NCTI and Enrichment Services since 2001. The recommended amendment to the contracts will allow Probation to continue to provide NCTI and Enrichment Services to youth who are residents of San Bernardino County who are either: 1) 11 to 18 years of age, and are either on formal Court Probation for law violations, or under Informal Probation, Summary Probation, or Deferred Entry of Judgement, and/or at-promise of developing delinquent behavior, or 2) 18 to 23 years of age and are on formal Adult or Juvenile Probation, or on California Department of Justice post discharge (reentry) supervision. Probation provides NCTI and Enrichment Services that are designed to effectively meet the diverse needs of juveniles, while concurrently maximizing public safety through a reduction in recidivism. The purpose of NCTI and Enrichment Services is to help youth understand and overcome problems in an effort to discontinue inappropriate and/or unlawful behavior.

 

On June 22, 2021 (Item No. 53), as a result of a formal procurement, the Board of Supervisors (Board) approved 11 contracts, four of the contracts were with the agencies listed in the Recommendation, and also contracts with Behavioral Awareness Center of San Bernardino County (Contract No. 21-477), Family Service Agency of San Bernardino (FSA) (Contract No. 21-481), Mental Health Systems, Inc. (Contract No. 21-484), Operation New Hope (Contract No. 21-485), San Bernardino Community College District (Contract No. 21-486), Young Visionaries Youth Leadership Academy (Contract No. 21-487), and Citrus Counseling Services, Inc., formerly known as Christian Counseling Service of East Valley, Inc. (Contract No. 21-479) to provide NCTI and Enrichment Services to Probation youth, in an aggregate amount not to exceed $6,000,000, for the total contract period of July 1, 2021 through June 30, 2024.

 

Contract No. 21-481 with FSA was terminated effective December 31, 2022, at FSA’s request, as FSA merged with another agency and ceased to exist as a separate entity.

 

Contract No. 21-477 with Behavioral Awareness Center of San Bernardino County was terminated effective March 21, 2024, as the contractor failed to meet insurance requirements.

 

Contract No. 21-484 with Mental Health Systems, Inc. was terminated as Mental Health Systems did not agree to renew effective June 30, 2024,

 

Contract No. 21-479 with Citrus Counseling Services, Inc. ended on June 30, 2024 as they did not agree to renew the contract for the remaining one-year extension.

 

On April 23, 2024 (Item No. 35), the Board approved Amendment No. 1 to contracts with California Association of Health and Education Linked Professions (Contract No. 21-478), Citrus Counseling Services, Inc., formerly known as Christian Counseling Service of East Valley, Inc. (Contract No. 21-479), Empowering Success Now (Contract No. 21-480), Inland Valley Recovery Services (Contract No. 21-482), and Lutheran Social Services of Southern California, (Contract No. 21-483), exercising the first of two options to extend the contract by one-year, for a new total contract term of July 1, 2021 through June 30, 2025.

 

The recommended amendment extends the total contract period by one year with no change to the aggregate not to exceed amount of $6,000,000 for the five-year contract period.

 

The contracts are written in this manner to establish a Board approved list of qualified vendors to allow Probation the flexibility of selecting the vendor that best meets County and client service needs. The contracts do not include a guaranteed minimum or maximum number of referrals, and contractors will be paid on a fee-for-service basis. The contracts may be terminated by the County without cause with 30-day written notice to the contractor. County staff will monitor contractor invoices at both the individual and aggregate levels to ensure total payments do not exceed the authorized amounts.

 

Contractor performance will continue to be monitored by review of monthly reports and annual monitoring by County staff to ensure compliance with the administrative, program, and fiscal terms and conditions of the contract.
