Approve Amendment No. 1 to Contract No. 24-532 with Bear Electrical Solutions, LLC, for traffic signal maintenance services, increasing the contract amount by $750,000, from $2,123,000 to $2,873,000, removing the annual not-to-exceed cap of $424,600 to allow greater flexibility in meeting variable maintenance needs while remaining within the total contract amount, and with no change to the term of July 1, 2024, to June 30, 2029.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost) as the cost to maintain the traffic signals, in-ground flashing lights, streetlights, and flashing beacons (collectively, Traffic Signal Maintenance) will be funded with Gas Tax revenue. Sufficient appropriation and revenue are included in the Department of Public Works (Department) 2024-25 Road Operations budget and will be included in future recommended budgets.

 

BACKGROUND INFORMATION

The Department is responsible for countywide Traffic Signal Maintenance on highways that are a part of the County Maintained Road System. On June 11, 2024 (Item No. 75), after a competitive procurement process, the Board of Supervisors (Board) approved Contract No. 24-532 (Contract) with Bear Electrical Solutions, Inc., for Traffic Signal Maintenance services. The Contract covers 96 signalized intersections, 37 yellow flashing light/safety light and in-ground flashing light locations, and 36 street light locations for an annual not-to-exceed amount of $424,600, and a total not-to-exceed amount of $2,123,000, for the five-year term. Following the execution of the Contract, in or about August 2024, Bear Electrical Solutions, Inc., converted its corporate status to Bear Electrical Solutions, LLC (Bear Electrical).

 

The Department conducts monthly reviews of contract expenditures and determined that the Contract is approaching the current annual not-to-exceed amount due to unanticipated and increased service needs. This increased usage is largely driven by more frequent responses to power outages, traffic accidents, and signal changes.

 

Approval of Amendment No. 1 (Amendment) will increase the total Contract amount by $750,000, from $2,123,000 to $2,873,000, for the remainder of the existing term, July 1, 2024, through June 30, 2029. The Amendment will also remove the annual not-to-exceed cap of $424,600, providing greater flexibility to address fluctuating maintenance needs, while remaining within the total Contract amount.

 

This Amendment will ensure the Department can continue to respond promptly to Traffic Signal Maintenance needs as they arise.

 

This item aligns with the County and the Chief Executive Officer’s goals and objectives to provide for the safety of the traveling public by ensuring safety and maintenance of reliable transportation infrastructure.
