Recommendation
1. Acting as the governing body of San Bernardino County:
a. Approve Interagency Memorandum of Understanding No. ARPA21-IAM-002 between San Bernardino County and County Service Area 70 - Countywide, to execute and fund the Camp Switzerland Sewer Lift Station Project, for the initial period of October 1, 2024 through December 31, 2026, in the not-to-exceed amount of $181,112.25.
b. Approve Interagency Memorandum of Understanding No. ARPA21-IAM-003 between San Bernardino County and County Service Area 70 - Countywide to execute and fund the Chino Airport Remedial Action Project, for the initial period of October 1, 2024 through December 31, 2026, in the not-to-exceed amount of $85,831.99.
c. Approve Interagency Memorandum of Understanding No. ARPA21-IAM-007 between San Bernardino County and County Service Area 29 - Lucerne Valley, to execute and fund the Lucerne Valley Community Center Renovation Project, for the initial period of October 1, 2024 through December 31, 2026, in the not-to-exceed amount of $49,984.62.
d. Approve Interagency Memorandum of Understanding No. ARPA21-IAM-008 between San Bernardino County and County Service Area 42 - Oro Grande, to execute and fund the Oro Grande Park Revitalization Project, for the initial period of October 1, 2024 through December 31, 2026, in the not-to-exceed amount of $74,589.20.
e. Approve Interagency Memorandum of Understanding No. ARPA21-IAM-009 between San Bernardino County and County Service Area 82 - Searles Valley, to execute and fund the CSA 82 Searles Valley Sewer Improvement Project, for the initial period of October 1, 2024 through December 31, 2026, in the not-to-exceed amount of $147,708.29.
f. Approve Interagency Memorandum of Understanding No. ARPA21-IAM-011 between San Bernardino County and the County Service Area 70M - Wonder Valley, to execute and fund the CSA 70M Wonder Valley Community Center Upgrades Project, for the initial period of October 1, 2024 through December 31, 2026, in the not to exceed amount of $109,770.47.
g. Approve Interagency Memorandum of Understanding No. ARPA21-IAM-001 between San Bernardino County and the Bloomington Recreation and Park District, to execute and fund the Ayala Park Splash Pad Project, for the initial period of October 1, 2024 through December 31, 2026, in the not-to-exceed amount of $100,000.

a. FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost) as these projects are funded by the American Rescue Plan Act (ARPA) - Coronavirus Local Fiscal Recovery Fund (CLFRF). San Bernardino County received a direct allocation of $423.5 million under the ARPA CLFRF to bolster the County’s response to the COVID-19 Pandemic and its economic impact. The Board of Supervisors (Board) approved an expenditure plan for the use of these funds, known as the County Local Fiscal Recovery Spending Plan (Spending Plan), on June 8, 2021 (Item No. 121) and amended the plan on August 24, 2021 (Item No. 21).
Sufficient appropriations have been included in each District’s 2024-25 budget and will be included in future budgets as necessary.
BACKGROUND INFORMATION
On March 11, 2021, the ARPA was signed into law and established the $350 billion Coronavirus State and Local Fiscal Recovery Fund to distribute resources to state and local governments throughout the nation.
The County has established an ARPA Administration Team under County Administrative Office (CAO) - Finance and Administration who reviews all potential projects to determine if the project scope and the use of funds are eligible for ARPA funding in accordance with the Board approved Spending Plan, as well as the United States Department of the Treasury’s (U.S. Treasury) Final Rules and other relevant guidelines. On November 9, 2023, the U.S. Treasury released a new interim final rule to address ARPA recipients’ questions regarding the definition of obligations. This rule provides clarification on how to oblige certain costs by using a method other than contracts and subawards in order for such cost to be considered as obligated within the eligible ARPA covered period.
The Camp Switzerland Sewer Lift Station Project will construct a redundant dual pump/dual pipe sewer lift station system to move sewage from the low point of the camp to existing gravity feed sewer lines on the existing dirt road. When completed, the system will service the planned new cabins and camp site, ensuring adequate capacity of sewage transport to the existing collector pipe for proper disposal.
The Chino Airport Groundwater Remedial Action Project consists of the construction of pipelines and associated valves and appurtenances and the installation of groundwater wells within the Airport. This includes the construction of approximately 17,500 linear feet of 16-inch, 12-inch, 8-inch and 6-inch C-900 PVC Raw Water Pipeline, installation of a fiber optic communication network, construction of five groundwater pumping wells, equipment for 10 groundwater pumping wells, construction of five monitoring wells, and construction of five wells sites with masonry building for electrical equipment.
The CSA 29 Lucerne Valley - Community Center Renovation Project will fund renovations to the kitchen equipment, bathrooms and will ensure the community center complies with current Americans with Disabilities Act (ADA) accessibility standards. The scope of work will also include walkway repairs and modifications to park facilities within Pioneer Park.
The CSA 42 Oro Grande - Oro Grande Park Revitalization Project Phase 1 includes the demolition of the community center structure. Phase 2 includes various future park improvements. Phase 2 of the Project includes replacement of playground equipment, resurfacing and restriping the basketball court, installation of fitness equipment, installation of shade structures, ADA parking improvements and other park improvements such as landscaping and flatwork.
The CSA 70M Wonder Valley - Community Center Upgrades Project will fund renovations to the community kitchen improvements, replacement of the kitchen and bathroom flooring, installation of lighting for energy efficiency and safety, and commercial grade reverse osmosis water filtration system installation due to the fluoride, arsenic, and other contaminants that exceed regulation levels.
The CSA 82 Searles Valley Sewer Improvement Project will replace 6,574 lineal feet of the 12-inch effluent sewer line and at least 12 manhole structures in order of priority determined by current conditions. The project will also add up to six manholes to reduce spacing to a consistent 500 to 600 feet allowing for additional access points for maintenance and inspection purposes pursuant to industry standards.
The Ayala Park Splash Pad Project proposes the construction of a 40-foot diameter splash pad. The new water system will utilize water storage tanks, purification systems, recirculation pumps, and programmable controllers to ensure water conservation and sufficient water supply to the new splash pad.
The U.S. Treasury issued a new guidance that all ARPA CLFRF recipients, including the County, should enter into interagency agreements, including memoranda of understanding, by December 31, 2024 for ARPA project costs that, otherwise, cannot be obligated via contracts between departments and legally separate agencies within the same governing body.
Approval of the Memoranda of Understanding (MOUs) will ensure that the County is in compliance with the U.S. Treasury’s revised statutory requirement by obligating all of the ARPA payroll and other project costs, listed in the Recommendations, as of October 1, 2024. The requirement is a result of the most recent U.S. Treasury reporting ending on September 30, 2024 to reflect actual costs incurred before December 31, 2024 through entering into interagency agreements that require such costs to be expended by December 31, 2026.
This item is being submitted to the board for approval at the earliest available meeting after the required fiscal, operational, and legal reviews. Approval of this item will provide the County with greater latitude to assist the residents and general public to recover from the negative effects of the recent pandemic as doing so will allow the County to continue to carry out completing the aforementioned ARPA projects without any undue interruption or cancellation.
The CAO - Finance and Administration and Department of Public Works - Special Districts reviewed all these MOUs on behalf of the County and Board Governing County Service Areas, respectively, and recommend approval of the MOUs with these terms and conditions.
