RECOMMENDATION(S)

Recommendation

1.                     Approve Amendment No. 2, effective October 27, 2020, to Contract No. 20-607 with Fulgent Genetics for purchase and distribution of SARS-CoV-2 test kits, collection of used kits,   processing of samples in a certified laboratory, and adding COVID-19 Picture test kits, increasing the total by $17,277,500, from $10,000,000 to a total not to exceed $27,277,500, with no change to the contract period of July 21, 2020 through January 31, 2021.

2.                     Authorize the Auditor-Controller/Treasurer/Tax Collector to post the adjustments as indicated in the Financial Impact section below to the Department of Public Health’s 2020-21 budget in the amount of $27,277,500 for the Public Health COVID-19 Crisis Response funding (Four votes required).

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The increase of $17,277,500 is eligible for reimbursement to the County through the Federal Coronavirus Aid, Relief and Economic Security (CARES) Act Coronavirus Relief Funds if no other COVID-19 related federal or state funding is available. The Department of Public Health (DPH) is requesting the budget adjustment to the 2020-21 budget noted in the table below.

BACKGROUND INFORMATION

The recommended contract amendment with Fulgent Genetics (Fulgent) will allow the County to purchase additional SARS-CoV-2 test kits, including at-home Picture test kits, and related collection and processing in a certified laboratory, as well as results reporting. These test kits will be supplied to the various testing sites throughout the County, and will provide results within 24 - 48 hours from receipt and acceptance of the test kits by Fulgent laboratories.

 

The COVID-19 virus originated in late 2019 and began spreading, initially, within China and then to other countries.  On January 30, 2020, the World Health Organization declared the outbreak to be a “public health emergency of international concern”.  This was followed on January 31, 2020 by the United States Human Services Secretary declaring a public health emergency.  Cases internationally, within the US and within California (as evidenced by the Governor’s Proclamation) continue to rise.

 

On March 4, 2020, Governor Newsom issued a Proclamation of a State of Emergency as a result of the COVID-19 outbreak due to the rising number of confirmed cases and anticipated complications for those infected.  On March 10, 2020, the County Public Health Officer declared a local health emergency to help ensure county government and the public were prepared for the possibility that COVID-19 will appear within the county.  On March 10, 2020 (Item No. 75), the Board of Supervisors proclaimed the existence of a local emergency within San Bernardino County resulting from COVID-19, which causes infectious disease resulting in symptoms of fever, coughing and shortness of breath with outcomes ranging from mild to severe illness and in some cases, death.

 

PROCUREMENT

On August 11, 2020 (Item No. 21), the Board of Supervisors (Board) ratified Contract No. 20-607 with Fulgent for purchase and distribution of SARS-CoV-2 test kits, collection of used kits and processing of samples in a certified laboratory, in an amount not to exceed $3,900,000, effective July 21, 2020 through January 31, 2021, approved by the Chief Executive Officer on July 21, 2020.

 

In addition on August 11, 2020 (Item No. 35), the Board approved Amendment No. 1 to Contract No. 20-607 with Fulgent, increasing the total by $6,100,000, from $3,900,000 to a total not to exceed $10,000,000, with no change to the total contract period of July 21, 2020 through January 31, 2021.
