Recommendation
1. Approve Cooperative Agreement with the City of Rialto, effective August 22, 2023, through January 31, 2026, or project completion/final payment for the Pavement Reconstruction and Americans with Disabilities Act Curb Ramp Update Project on Easton Street in the Rialto area, whichever occurs first, wherein the County will contribute $82,100 and the City of Rialto will contribute $1,147,941 towards the estimated total cost of $1,230,041.
2. Authorize the Director of the Department of Public Works or Assistant Director of the Department of Public Works, to increase the County contribution amount up to 25 percent, from $82,100 to $102,625, should additional costs necessitate such an increase.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The total estimated cost of the Pavement Improvement and Americans with Disabilities Act (ADA) Curb Ramp Update Project on Easton Street Avenue in the Rialto area (Project) is $1,230,041. The County’s share of the cost is estimated to be $82,100 and will be funded with Gas Tax funds. The remaining cost of the Project, estimated to be $1,147,941, will be funded by the City of Rialto (City). Sufficient appropriation and revenue for the Project are included in the Department of Public Works (Department) 2023-24 Road Operations budget and will be included in future recommended budgets (6650002000 H15231).
BACKGROUND INFORMATION
The City and County share jurisdiction of Easton Street from 0.01 miles west of North Brampton Avenue east to Fillmore Avenue. The City presented the County with construction plans for Easton Street to reconstruct existing pavement and overlay the pavement with new rubberized hot mix asphalt and update four ADA curb ramps to comply with ADA requirements. Other improvements include the reconstruction of sidewalks, curb, and gutter.
The Easton Street repaving was originally part of the Blake Street and Other Roads Project approved by the Board of Supervisors (Board) on October 26, 2021 (Item No. 47) but was removed from that project list so that it could be repaved at an earlier date as part of the City’s project. The Easton Street resurfacing is anticipated to commence in Summer 2023.
In accordance with the provisions of the proposed Cooperative Agreement, the City will serve as the lead agency in the preliminary engineering, design, survey, California Environmental Quality Act (CEQA) review and compliance, construction and inspection phases of the Project. If right-of-way is necessary for the Project, the City and County will each perform the service within their respective jurisdictions, at their own cost.
Unless terminated prior to the award of the construction contract, the proposed Cooperative Agreement will terminate upon completion of the Project and final payment by the County or refund by City, or on January 31, 2026, whichever occurs first. The City approved the Cooperative Agreement on August 8, 2023.
To prevent delays in Project completion, this item also recommends that the Board authorize the Director of the Department or the Assistant Director, to increase the County’s contribution amount under the proposed Cooperative Agreement by up to 25 percent, from $82,100 to no more than $102,625, should contractor bids exceed the original project estimate or improvement costs necessitate such an increase.
The Project meets the County and the Chief Executive Officer’s goals and objectives to ensure the development of a well-planned, balanced and sustainable County by preserving and improving the structural integrity of the existing road surfaces and by adding ADA compliant curb ramps. Furthermore, execution of the Cooperative Agreement will allow the County to meet its goals and objectives by working cooperatively with the City.
