RECOMMENDATION(S)

Recommendation

1.                     Acting as the governing body of the San Bernardino County Flood Control District, approve Amendment No. 1 to Memorandum of Understanding No. 20-1238 with the San Bernardino County Fire Protection District, for maintenance activities, in a not-to-exceed annual amount of $1,000,000, increasing by $5,000,000 from $5,000,0000 to total new cumulative amount of $10,000,000, and extending the term for an additional five years, for a total contract period of December 15, 2020 through December 31, 2030, with all other terms remaining unchanged.

2.                      Acting as the governing body of the San Bernardino County Fire Protection District, approve Amendment No. 1 to Memorandum of Understanding No. 20-1238 with the San Bernardino County Flood Control District, for maintenance activities, in a not-to-exceed annual amount of $1,000,000, increasing by $5,000,000 from $5,000,0000 to a total new cumulative amount of $10,000,000, and extending the term for an additional five years, for a total contract period of December 15, 2020 through December 31, 2030, with all other terms remaining unchanged.

FINANCIAL IMPACT

Approval of the recommended actions will not result in the use of Discretionary General Funding (Net County Cost). The San Bernardino County Flood Control District (District) is funded by property tax revenue, fee revenue, and local, state, and federal funding, and the San Bernardino County Fire Protection District (SBCFPD) is funded primarily by property taxes and contract/fee revenues.

 

Costs incurred pursuant to this Memorandum of Understanding (MOU) will be invoiced to each party, with an annual not-to-exceed amount of $1,000,000 for each party. Sufficient appropriation and revenue for this MOU is included in the 2025-26 budget for the District and SBCFPD and will be included in future recommended budgets.

 

BACKGROUND INFORMATION

On December 15, 2020 (Item No. 79), the Board of Supervisors and the Board of Directors (collectively Board) approved MOU No. 20-1238 for the provision of mutual maintenance services to each other by sharing their existing labor and equipment forces, as needed. Pursuant to the MOU, SBCFPD will provide weed abatement and brush clearing services, and the District will provide arborist services. The MOU supports the County goals of improving county government operations, maintaining public safety, and operating in a fiscally responsible and business-like manner.

 

Approval of Amendment No. 1 to the MOU will increase the contract total by $5,000,000, from $5,000,0000 to a total new cumulative amount of $10,000,000, extend the term for an additional five years, continuing through December 31, 2030, and update the mailing address information for SBCFPD, due to the relocation of its headquarters. All other terms remain the same.
