Recommendation
Adopt a blanket resolution to designate the Chairperson of the Board of Supervisors as the authorized signatory to execute specified Master funding agreements and any amendments thereto, with the California Department of Transportation on behalf of the County of San Bernardino:

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). There is no financial impact with adoption of the resolution. This item provides the California Department of Transportation (Caltrans) formal notification that the Chairperson of the Board of Supervisors (Board) is the authorized signatory in executing agreements and related amendments with Caltrans on behalf of the County of San Bernardino.
BACKGROUND INFORMATION
This blanket resolution will eliminate the need to include a specific recommendation in Board items under which the Board grants authority for the Chairperson of the Board to sign specific Caltrans agreements listed below. Currently, whenever these agreements are presented to the Board for approval, Caltrans requires the County to specifically include a recommendation authorizing the Chairperson to sign the agreements. With adoption of a Blanket Resolution, all agreements specified below and any relevant amendments will be presented to the Board for approval, but will not need a recommendation to authorize the Chairperson to sign the agreement. All other agreements follow regular County policies for Board approval.
This allows the County to comply with Caltrans policies and procedures by formally designating the Chairperson of the Board as the person authorized to enter into the Master funding agreements with Caltrans. The County receives federal and state funding for transportation projects through Caltrans under various project funding programs. The County often enters into the various agreements with Caltrans to outline the roles and responsibilities of each agency with regards to project delivery.
This authorization would apply to the following agreements:
Master Agreement: A Master Agreement is required with a local agency whenever federal or state funds are to be used on a local project. In the Master Agreement, a local agency agrees to comply with all federal and state laws, regulations, policies and procedures relative to the development and delivery of a project.
Program Supplement: Supplement to the Master Agreement formalizes the financial responsibilities and provisions for a specific federal-aid or state funded project. It is the contractual basis for the state to pay the local agency for work done on that specific project.
Federal Apportionment and State Match Agreement: Under the provisions of California Streets & Highways Code 182.6 et seq., Metropolitan Planning Organizations, Regional Transportation Planning Agencies, and counties are allowed to exchange certain portions of their federal-aid funds for State Highway Account funds, which have fewer restrictions than federal funds.
Fund Transfer Agreement: A project funding agreement required for certain programs in which the California Transportation Commission, as opposed to Caltrans, allocates funding for a project.
This item allows the County to meet its goals and objectives by working cooperatively with Caltrans in executing agreements.
