Recommendation
Approve fee-for-service contracts with the following companies for the provision of inspection, review and analysis of County facilities, operations, and equipment to ensure compliance with State and Federal regulations, environmental and occupational health regulations, and compliance with the Standard Practice Insurance and Indemnity Policy, for an aggregate amount not to exceed $670,000, for the period of April 17, 2022 through April 16, 2027:

FINANCIAL IMPACT
Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). The estimated annual cost of $134,000 for risk control services will be paid from various Department of Risk Management (DRM) funds. These services will be paid on a fee for service basis in accordance with contracted rates stated in the contract. Sufficient appropriation and revenue are available in the 2021-22 DRM budget and will be included in future recommended budgets.
BACKGROUND INFORMATION
On January 1, 2000, legislation authorized the assessment of monetary penalties against public
entities for California Department of Industrial Relations, Division of Occupational Safety and Health (CAL/OSHA) violations and citations. In addition, the County is required to comply with CAL/OSHA ergonomic standards. Due to this mandate, there is an ongoing need for inspection and monitoring of over 3,000 County facilities located over 20,000 square miles. By utilizing specialty risk control services to supplement in-house resources, DRM can expedite the inspection of County facilities, equipment and operations to ensure compliance with State and Federal regulations. Such services will also reduce the County’s cost of claims, accidents and injuries, and will assist in the avoidance of monetary penalties.
Risk control vendors provide services such as training classes on asbestos, crane/heavy equipment, fall protection, flagging, forklift, hazmat, ladder, lifting, respirator, scaffold and shoring. They conduct inspections for asbestos, radiation dosimetry, electrical, bark beetle emergency, and crane and fall protection. They also perform ergonomic assessments, mold studies, industrial hygiene services, and lead studies.
PROCUREMENT
On August 30, 2021, DRM released Request for Proposal (RFP) No. RMG121-RMADM-4248, soliciting proposals for risk control services. The RFP was posted on San Bernardino County’s Electronic Procurement Network (ePro), and the following six proposals were received:

An evaluation panel composed of staff from County Counsel, Facilities Management, Performance, Education & Resource Center (PERC), and DRM evaluated the proposals based on compliance with the RFP requirements, qualifications, and experience, proposed work plan, expertise in risk control services, references, and cost. The evaluation panel recommended a contract be awarded to all proposers. The County and proposers successfully negotiated the fee schedule on Attachment A of the contract.
