RECOMMENDATION(S)

Recommendation

1.                     Approve Job Order Contracts to provide pavement maintenance in the San Bernardino County Valley area, in an amount not to exceed $1,500,000 per contract, for the period of February 10, 2026, through February 9, 2027, with the following contractors:

a.                     Pavement Coatings Co.

b.                     SJD&B, Inc.

c.                     PUB Construction, Inc.

2.                     Authorize the Director, Assistant Director, Deputy Director, and Contracts Division Chief of the Department of Public Works to approve any and all plans, specifications, and project descriptions for projects performed by Job Order Contract contractors, including, but not limited to, roadway maintenance, rehabilitation, and Americans with Disabilities Act upgrades, as these individuals shall determine are necessary.

3.                     Authorize the Director, Assistant Director, Deputy Director, and Contracts Division Chief of the Department of Public Works to issue individual job orders under the Job Order Contracts in Recommendation No. 1.

4.                     Authorize the Director of the Department of Public Works to accept the work when 100% complete and execute and file the Notice of Completion for projects and job orders.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The Department of Public Works (Department) is funded by Gas Tax revenue, fee revenue and other local, state and federal funding. Depending on the project, one of these funding sources will be used. The maximum contract value for each Job Order Contract (JOC) is $1,500,000. Sufficient appropriation and revenue are included in the Department’s 2025-26 Road Operations budget (6650002000) and will be included in future recommended budgets.

 

BACKGROUND INFORMATION

A JOC is a competitively bid, firm fixed priced, indefinite quantity contract authorized under California Public Contract Code section 20128.5, in which the Contractor may perform an ongoing series of individual projects at different locations within the San Bernardino County Valley area. JOCs provide an efficient and cost-effective method for counties to procure repair, remodeling, or other repetitive work to be done according to unit prices without the need to separately bid each project. Under a JOC, contractors bid a set of adjustment factors to be applied to a pre-established Unit Price Book that reflects local labor, material, and equipment costs. Once awarded, the JOC enables the County to issue individual job orders for specific scopes of work, with each job order performed in accordance with the approved contract terms and specifications.

 

Since the JOC program functions by issuing numerous individual job orders for discrete projects over the course of the contract term, each job order requires the preparation and approval of project-specific plans, specifications, and a defined scope of work before a purchase order and job order can be issued to the contractor. These approvals occur repeatedly throughout the year as maintenance, rehabilitation, and accessibility needs arise. Delegating authority to the Director, Assistant Director, Deputy Director, and Contracts Division Chief of the Department of Public Works to approve these plans and specifications for project documents is essential to the efficient administration of the JOC program and is consistent with the purpose of JOCs under Public Contract Code section 20128.5, which is to streamline delivery of repetitive public works.

 

The bid documents include Special Provisions with a Unit Price List. All Unit Prices are based on local labor, material and equipment prices and are for the direct cost of construction. It is placed with the “Contractor” for the accomplishment for pavement maintenance of streets, highways, and county facilities, repair, maintenance, rehabilitation, demolition and construction of infrastructure, or other real property within San Bernardino County Valley area.

 

The JOC delivery method is particularly well suited for pavement maintenance, as it allows the County to respond quickly to repair and rehabilitation needs on streets, highways, and facilities throughout the San Bernardino County Valley area. This reduces project delivery time, ensures consistency in pricing, and promotes cost control across multiple small- to medium-sized projects.

 

The term of the JOC will be either for one year or when issued Job Orders totaling the Maximum Contract Value have been completed, whichever occurs first. All Job Orders must be issued but not necessarily completed within one calendar year of the commencement date of the Contract. All Job Orders issued during the term of this Contract shall be valid and in effect notwithstanding that the detailed scope of work may be performed, payments may be made, and the guarantee period may continue, after such period has expired. All terms and conditions of the Contract apply to each job order.

 

PROCUREMENT

On October 6, 2025, the Assistant Executive Officer approved the JOC specifications, as well as authorized the Director of the Department to advertise the Project for bids. This Project was advertised in the San Bernardino County Sun newspaper on October 22, 2025, and released on the County electronic procurement network (ePro) on October 21, 2025. Notice inviting bids was also provided to specified construction trade journals identified pursuant to Public Contract Code section 22036. On December 4, 2025, the following nine bids were received:

The Department has reviewed the bids received and determined that they are responsive, and recommends entering into a contract with Pavement Coatings Co., SJD&B, Inc., and PUB Construction, Inc., the three lowest, responsive and responsible bidders. No appeal/protest letters were received.
