RECOMMENDATION(S)
Recommendation
1. Approve non-financial Data Use Agreement for Nonpublic Patient Level Data with the California Department of Health Care Access and Information, to allow for the exchange of health-related and population information, effective upon execution by all parties and until canceled by either party.
2. Approve Limited Data Request No. CS0002741 to the California Department of Health Care Access and Information, to request and receive health-related and population non-public patient level data.
3. Authorize the Health Officer or the Deputy Health Officer to electronically execute and submit the non-financial Data Use Agreement for Nonpublic Patient Level Data, the Limited Data Request No. CS0002741, any subsequent non-substantive amendments related to the Data Use Agreement for Nonpublic Patient Level Data, and future Limited Data Requests to the California Department of Health Care Access and Information, as required by the California Department of Health Care Access and Information, to allow the department to request, receive, monitor and analyze health-related and population data, on behalf of the County, subject to review by County Counsel.
4. Direct the Health Officer or the Deputy Health Officer to transmit non-financial Data Use Agreement for Nonpublic Patient Level Data with the California Department of Health Care Access and Information, and any subsequent non-substantive amendments to the agreement, and Limited Data Request No. CS0002741 to the Clerk of the Board of Supervisors within 30 days of execution.

FINANCIAL IMPACT
The Data Use Agreement for Nonpublic Patient Level Data (Agreement) and Limited Data Request No. CS0002741 (Data Request) with the Department of Health Care Access and Information (HCAI) are non-financial in nature and, as such, will not result in the use of Discretionary General Funding (Net County Cost).
BACKGROUND INFORMATION
The Agreement with HCAI authorizes the Department of Public Health (DPH) to request, receive, and utilize data obtained from HCAI via the data request process, in accordance with Health and Safety Code section 128766.
The Agreement sets forth the data privacy and security requirements, stipulated by the California Department of Public Health. Execution of the Data Request is required for DPH to request access to limited data sets for hospital inpatient data and emergency department data for the period of 2014-2023 at the county and ZIP code level. Future Limited Data Requests will be required for years beyond 2023, for which delegated authority is requested in Recommendation No. 3. The data will be used to produce numerous indicators for the DPH Maternal, Child and Adolescent Health program to monitor and track local data describing the health of women, infant, children, and families.
HCAI is a State agency which provides nonpublic data to licensed California Hospitals and Local Health Departments for conducting authorized research and activity in order to inform and develop strategies to improve community health. Information requested from HCAI includes patient-level diagnosis, treatment, medical history, geographic location, hospital (including Emergency Department) visits, discharges, etc.
Use of this data will enhance DPH’s ability to conduct community needs assessments, draft reports, develop data dashboards, compile descriptive statistics, and conduct trend analysis in order to develop strategies to reduce health equity disparities and improve well-being. The findings will directly inform public health strategies aimed at addressing the health of the community.
