RECOMMENDATION(S)
Recommendation
1. Approve Grant Agreement with the State of California, Department of Parks and Recreation - Division of Boating and Waterways (Award No. C20L0620), in the amount of up to $60,000, effective the date fully executed and in effect for fifteen years, for the purchase of a remotely operated underwater vehicle.
2. Approve the 15-year term of the Grant Agreement with the State of California, Department of Parks and Recreation - Division of Boating and Waterways (Award No. C20L0620) to provide funding to purchase a remotely operated underwater vehicle, as an exception to the Standard County contract term of five years established in County Policy 11-06 SP 1.
3. Authorize the Chairman of the Board of Supervisors or the Sheriff/Coroner/Public Administrator to sign and submit the Grant Agreement and the required certifications, as required by the Division of Boating and Waterways.
4. Direct the Chairman of the Board of Supervisors or the Sheriff/Coroner/Public Administrator to transmit all documents related to the Grant Agreement to the Clerk of the Board of Supervisors within 30 days of execution.

FINANCIAL IMPACT
Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). This grant award will provide funding of up to $60,000 for the purchase of a remotely operated underwater vehicle (ROV) to the Sheriff/Coroner/Public Administrator (Department). Budget adjustments are not requested at this time, but will be included in a future quarterly countywide budget report presented to the Board of Supervisors (Board) for approval.
BACKGROUND INFORMATION
The State of California, Department of Parks and Recreation - Division of Boating and Waterways (DBW) provides funding to local law enforcement agencies through its Boating Safety and Enforcement Equipment Grant Program for the purchase of boats and equipment for use in boating law enforcement activities.
The Department’s Marine Enforcement Unit at the Colorado River Station is responsible for patrolling one of the busiest recreation waterways in the nation. The Colorado River waterway, including Lake Havasu, has approximately seventeen million visitors per year on ninety miles of waterway within the County’s jurisdiction. The Department operates and maintains the necessary equipment and personnel at the Colorado River Station to provide enforcement of boating regulations, assistance to boaters in distress, and to conduct search, rescue and recovery operations. In addition, the Department coordinates with the Sheriff’s departments in Mohave and La Paz counties (Arizona) to provide regular marine patrols and periodic task forces to enforce boating under the influence statutes.
On April 30, 2020, the Chief Executive Officer authorized the submission of a grant application to DBW, in the amount of $120,000, for the purchase of two ROVs. The County’s application was subsequently accepted and grant funds up to $60,000 for one ROV were allocated to the Department. Under this Grant Agreement, the DBW will provide reimbursement of eligible costs upon receipt of written payment request and documentation supporting the purchase.
The proposed ROV will be used by the Department to assist in search and rescue and recovery operations. The grant requires the ROV to be purchased between the date the agreement is fully executed and August 31, 2021. The term of the agreement is 15 years from the date of full execution, through September 30, 2035, period in which the Department will have to follow the agreement’s terms and conditions and use the ROV to provide boating law enforcement services. The 15-year duration of the agreement exceeds the County’s standard maximum contract term of five years, per County Policy 11-06, Standard Practice 1 (SP 1). Approval of Recommendation No. 2 will provide an exception to County Policy 11-06, SP 1.
PROCUREMENT
Procurement for the equipment listed in Recommendation No. 1 will be completed in accordance with the County’s procurement procedures.
