Cooperative Agreements with the City of San Bernardino for Pavement Improvement and Americans with Disabilities Act Curb Ramp Projects in the San Bernardino Area

RECOMMENDATION(S)

Recommendation

1.                     Approve the termination of Cooperative Agreement No. 21-782 with the City of San Bernardino, for pavement and Americans with Disabilities Act curb ramp improvements on various roads in the San Bernardino area.

2.                     Approve the following Cooperative Agreements with the City of San Bernardino, for the following pavement and Americans with Disabilities Act curb ramp improvement projects:

a.                     Cooperative Agreement for the Muscoy Area Rehabilitation - Phase I Project, wherein the County will contribute an estimated amount of $3,519,000, and the City of San Bernardino will contribute an estimated amount of $375,000, towards the estimated total cost of $3,894,000, effective May 6, 2025 through April 30, 2030, or until the project is completed and final payment is made, whichever comes first.

b.                     Cooperative Agreement for the Lynwood Drive and Other Roads Pavement Improvement Project, wherein the County will contribute an estimated amount of $7,110,000, and the City of San Bernardino will contribute an estimated amount of $1,730,000, towards the estimated total cost of $8,840,000, effective May 6, 2025 through April 30, 2030, or until the project is completed and final payment is made, whichever comes first.

c.                     Cooperative Agreement for the Citrus Street and Other Roads - Phase I Pavement Improvement Project, wherein the County will contribute an estimated amount of $5,724,000, and the City of San Bernardino will contribute an estimated amount of $239,000, towards the estimated total cost of $5,963,000, effective May 6, 2025 through April 30, 2030, or until the project is completed and final payment is made, whichever comes first.

d.                     Cooperative Agreement for the Old Waterman Canyon Road and Other Roads Pavement Improvement Project, wherein the County will contribute an estimated amount of $1,466,000, and the City of San Bernardino will contribute an estimated amount of $339,000, towards the estimated total cost of $1,805,000, effective May 6, 2025 through April 30, 2030, or until the project is completed and final payment is made, whichever comes first.

3.                     Authorize the Director of Public Works to increase the County’s contribution amount for each of the Cooperative Agreements in Recommendation No. 2, by up to 25 percent, for a combined total County contribution not-to-exceed amount of $22,273,750 for the projects:

a.                     Muscoy Area Rehabilitation - Phase I Project, from $3,519,000 to $4,398,750.

b.                     Lynwood Drive and Other Roads Pavement Improvement Project, from $7,110,000 to $8,887,500.

c.                     Citrus Street and Other Roads - Phase 1 Pavement Improvement Project, from $5,724,000 to $7,155,000

d.                     Old Waterman Canyon Road and Other Roads Pavement Improvement Project, from $1,466,000 to $1,832,500.

4.                     Authorize the Auditor-Controller/Treasurer/Tax Collector to post the necessary budget adjustments to the Department of Public Works 2024-25 budget, as detailed in the Financial Impact section (Four votes required).

FINANCIAL IMPACT

Approval of the four cooperative agreements listed in Recommendation No. 2 (Cooperative Agreements) will not result in the use of additional Discretionary General Funding (Net County Cost). The estimated total cost to construct these four projects is $20,502,000. The County’s estimated total share of cost for the projects is $17,819,000, which will be funded by Senate Bill 1 Road Maintenance and Rehabilitation Account (RMRA) revenues, Measure I Local Streets Pass Through Funds - San Bernardino Mountains revenues, and the County Infrastructure General Fund Reserve (Reserve). This item would allocate $3,829,000 from the Reserve for the Citrus Street and Other Roads Project. The City of San Bernardino (City) will be responsible for its total share of cost, estimated to be $2,683,000 for work within the City’s jurisdiction plus any additional cost resulting from the projects. The City’s total share of cost shall not exceed $3,353,750 (City’s total share of cost plus 25 percent). Sufficient appropriation and revenue for the projects’ preliminary engineering phase are included in the Department of Public Works (Department) 2024-25 Road Operations and Measure I Local Streets Pass Through Funds - San Bernardino Mountains budget (6650002000 H15161, H15162, and H15301, 6650002141 TX1821) and will be included in future recommended budgets.

 

The following 2024-25 budget adjustments are requested for the allocation of the County Reserve for the Citrus Street and Other Roads project:

BACKGROUND INFORMATION

The Cooperative Agreements includes four separate projects for the San Bernardino areas,  consisting of approximately 44.09 miles of pavement improvements, of which 4.38 miles are shared jurisdiction with the City, and four ADA curb ramps updates at various locations in the San Bernardino area.  The Projects described in Recommendations Nos. 2a, 2b, and 2d are in the design phase and Project 2c is scheduled for construction in Summer 2025. Each project will be constructed individually, beginning in 2024-25.

 

On April 17, 2018 (Item No. 39), and on April 30, 2019 (Item No. 53), the Board of Supervisors (Board) authorized funding for the Muscoy Area Rehabilitation, Pavement Rehabilitation and Americans with Disabilities Act Curb Ramp Project (part of the Blake Street and Other Roads project) as part of the 2018-19 Senate Bill 1 RMRA project list.

 

On April 21, 2020 (Item No. 45), the Board authorized funding for the Lynwood Drive and Other Roads, Mill and Overlay and Slurry Seal Project, as well as the Citrus Street and Other Roads, Mill and Overlay and Slurry Seal Project, as part of the 2020-21 Senate Bill 1 RMRA project list.

 

On October 26, 2021 (Item No. 47), the Board entered into Cooperative Agreement No. 21-782 (Agreement) with the City, which authorized the County and City to jointly cooperate in constructing various road improvements and ADA curb ramps updates for various projects in the San Bernardino and Rialto areas. Since the execution of the Agreement, the Department staff reevaluated various roads, within the project areas, and determined the scope of work needed updating. Some roads now require more construction than originally planned, while others have had pavement work completed by the City. Additionally, the original plan for some roads included sealing pavement cracks. However, further deterioration caused by the passage of time necessitated more extensive treatments.

 

On August 20, 2024 (Item No. 67), the Board authorized funding for the Old Waterman Canyon and Other Roads, Mill and Overlay and Slurry Seal Project, as part of the Measure I Local Street Pass-Through Funds Five-Year Capital Improvement Plan Project List and the Expenditure Strategy for 2024-25 through 2028-29.

 

Recommendation No. 1 will terminate the Agreement with the City, which included six projects under a single agreement, and replace it with the individual Cooperative Agreements for each project detailed in Recommendations Nos. 2a, 2b, 2c, and 2d.  Due to the passage of time, construction material costs have significantly increased. Additionally, both the County and City lack the necessary funds to complete all projects under the current agreement. As a result, both parties agree that the most practical solution is to proceed with the projects individually under separate cooperative agreements. The individual Cooperative Agreements include three of the projects originally identified in the Agreement. The County and City agree to revisit the remaining three projects under the Agreement, which are Arden Avenue and Other Roads, Third Street and Other Roads, and North San Bernardino Area Curb Ramps Projects, as funding becomes available.

 

Recommendation No. 2.d requests the Board’s approval to enter into a cooperative agreement with the City, which was not part of the Agreement, for pavement improvements on Old Waterman Canyon Road and Other Roads in the San Bernardino Area.

 

Pursuant to the terms of the Cooperative Agreements in Recommendation Nos. 2a, 2b, 2c, and 2d, the County will be the lead agency in the preliminary engineering, design, survey, construction, construction engineering inspection, and California Environmental Quality Act (CEQA) review and compliance of the projects. The City agrees to provide the County with no-cost permits for work in the City’s right-of-way and pay its share of the projects’ costs as provided in the individual Cooperative Agreements. Unless terminated prior to the award of the construction contracts, the Cooperative Agreements terminate upon completion of construction and payment by the City to the County, or April 30, 2030, whichever occurs first. The City approved the Cooperative Agreements listed in Recommendation Nos. 2a through 2d on April 16, 2025.

 

Recommendation No. 3 requests the Board to authorize the Department’s Director to increase the County’s contribution amount under the Cooperative Agreements by up to 25 percent for each project, should costs dictate such an increase, to prevent delays in project completion. The County’s total share of costs shall not exceed $22,273,750, and the City’s share cost shall not exceed $3,353,750, absent written amendments to the Cooperative Agreements.

 

By preserving and improving the structural integrity of the existing roadway surfaces, as well as improving access for pedestrians and removing architectural barriers for those with mobility challenges, the Cooperative Agreements align with the County and the Chief Executive Officer’s goals and objectives to ensure development of a well-planned, balanced, and sustainable county as well as working with other agencies.

 

A companion item is on today’s agenda to award the construction contract to Vance Corp. for the construction of the Citrus Street and Other Roads Project.
