RECOMMENDATION(S)

Recommendation

1.                     Approve Amendment No. 2 to Contract No. 23-160 with Precision Advocacy Group LLC, for state legislative advocacy services, increasing the contract by $480,000 plus travel expenses, from $720,000 plus travel expenses to a total not to exceed amount of $1,200,000 plus travel expenses, and extending the term by two years, for a new contract period of February 28, 2023 through February 27, 2028.

2.                     Approve Contract with Genesi LLC, for state legislative advocacy services, in the amount not to exceed $480,000 plus travel expenses, for a two-year period effective February 28, 2026 through February 27, 2028.

FINANCIAL IMPACT

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). The increase of a total not to exceed amount of $480,000 plus travel expenses for the Precision Advocacy Group LLC (Precision Advocacy) contract and the not to exceed amount of $480,000 plus travel expenses for the Genesi LLC (Genesi) contract will be funded within the Finance and Administration’s (Department) existing 2025-26 budget and will be included in future recommended budgets.

 

BACKGROUND INFORMATION

San Bernardino County (County) relies on advocacy services to advance the County’s legislative agenda with the California State government. Approval of this item will authorize the County to extend the current contract with Precision Advocacy for an additional two years and enter into a new two-year contract with Genesi for legislative advocacy services.

 

On February 28, 2023 (Item No. 29), as a result of Request for Proposal No. CAO123-BOS-4698, the Board of Supervisors (Board) approved Contract No. 23-160 with Precision Advocacy to provide state legislative advocacy services in an amount not to exceed $480,000 plus travel expenses from February 28, 2023 through February 27, 2025. On February 25, 2025 (Item No. 17), the Board approved Contract 23-160 Amendment No. 1 with Precision Advocacy, increasing the contract amount by $240,000 plus travel expenses, from $480,000 plus travel expenses to a total not to exceed amount of $720,000 plus travel expenses, and extending the term by one year, for a new contract period of February 28, 2023, through February 27, 2026.

Approval of Recommendation No. 1 will allow Precision Advocacy to continue, as a state research lobbying firm, to focus on major County priorities, and coordinate with statewide county associations. The Contract would increase by $480,000 plus travel expenses from $720,000 plus travel expenses to a total not to exceed of $1,200,000 plus travel expenses and extend the term by two years for a new contract period of February 28, 2023, through February 27, 2028.

 

On February 28, 2023 (Item No. 29), as a result of Request for Proposal No. CAO123-BOS-4698 the Board approved Contract No. 23-159 with Capitol Advocacy LLC (Capital Advocacy). Capitol Advocacy has served as the County’s state policy advocacy firm with a focus on advancing County priorities in State legislation. The Capitol Advocacy Account Manager assigned to the County has left Capitol Advocacy and started a new firm, Genesi. The County does not recommend extending the contract with Capitol Advocacy. Instead, to maintain uninterrupted legislative policy advocacy support and continuity during critical state legislative and budget cycles, the County seeks to enter in a two-year contract with Genesi. Approval of Recommendation No. 2 will allow the County to contract with Genesi, a policy advocacy firm, in the not to exceed amount of $480,000 plus travel expenses, for a two-year period of February 28, 2026, through February 27, 2028.

 

The contracts with Precision Advocacy and Genesi may be terminated by the County without cause with 30 days’ written notice.

 

PROCUREMENT

The Contract with Genesi is non-competitive based on specialized expertise and time constraint. The Managing Partner of Genesi has historical knowledge over County Legislative priorities necessary to maintain uninterrupted advocacy support. Maintaining continuity of advocacy representation is particularly important during the State legislative and budget cycle to avoid disruption to County priorities. The Purchasing Department concurs with this non-competitive procurement.
