RECOMMENDATION(S)
Recommendation
Acting as the governing body of County Service Area 70 CG Cedar Glen:
1. Approve and authorize submission of a financial assistance application to the State Water Resources Control Board under the Drinking Water State Revolving Fund, requesting an amount not to exceed $2,832,000 for the Substandard Water Distribution System Ongoing Replacement and Balsam Tank Replacement and New Wells Project.
2. Adopt Resolution, as required by the State Water Resources Control Board, which:
a. Authorizes the Chief Executive Officer and the Director of the Department of Public Works to sign, execute, and submit, for and on behalf of County Service Area 70 CG Cedar Glen, a financial assistance application and a financing agreement from the State Water Resources Control Board for the planning, design, and environmental phase of the Substandard Water Distribution System Ongoing Replacement and Balsam Tank Replacement and New Wells Project.
b. Designates the Chief Executive Officer and the Director of the Department of the Department of Public Works, to provide the assurances, certifications, and commitments required for the financial assistance application from the State Water Resources Control Board, as well as represent County Service Area 70 CG Cedar Glen in carrying out the responsibilities under the financing agreement, including certifying disbursement requests.
3. Direct the Director of the Department of Public Works to transmit the financial assistance application for the Substandard Water Distribution System Ongoing Replacement and Balsam Tank Replacement and New Wells Project for County Service Area 70 CG Cedar Glen to the Clerk of Board of Supervisors within 30 days of execution.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The Department of Public Works - Special Districts (Department) is seeking financial assistance in an amount not-to-exceed $2,832,000 from the State Water Resources Control Board (SWRCB) under the Drinking Water State Revolving Fund (DWSRF) for County Service Area 70 CG Cedar Glen (CSA 70 CG) Substandard Water Distribution System Ongoing Replacement and Balsam Tank Replacement and New Wells Project (Project). This funding would be used for the Project planning, design, and environmental costs. Funding for the Project construction phase will be sought separately.
If the financial assistance application is approved by the SWRCB under the DWSRF, the Department will return to the Board of Supervisors (Board) for acceptance of the financial assistance award, approval of the financing agreement, and any related budget adjustments.
BACKGROUND INFORMATION
The Project involves construction of replacement water main lines and pipe appurtenances within the CSA 70 CG, abandonment or removal of existing water lines, construction/installation of new well and well connections, inspection and replacement of lead and copper service lines, and corresponding planning, design, construction, and construction administration. The Project will increase capacity, enhance system reliability, increase treatment capacity, improve water quality, and upgrade the existing water distribution system where needs exist.
Approval of this item will authorize the submission of a financial assistance application to the SWRCB under the DWSRF requesting an amount not to exceed $2,832,000 for the Project. This item also adopts a Resolution, as required by SWRCB, which authorizes the Chief Executive Officer (CEO) and the Director of the Department to execute and submit the application and resulting financing agreement, to take certain actions needed in relation to the financial assistance application process, and carry out CSA 70 CG’s responsibilities under the resulting financing agreement. Although the resolution required by SWRCB delegates authority to the CEO and the Director of the Department, the Department will return to the Board for approval of the financing agreement, if selected for a grant award.
