RECOMMENDATION(S)

Recommendation

Ratify the approval of Amendment No. 5 to Grant Agreement No. 15-579 (State Agreement No. 15-009) with the State of California Coastal Conservancy for the Santa Ana River Trail, increasing the Grant Agreement by $3,000,000, from $3,909,425 to a new total of $6,909,425, with no change to the project completion date of February 28, 2025.

FINANCIAL IMPACT

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). There are no requirements for matching funds from Regional Parks Department (Department). The amendment with the State of California Coastal Conservancy (Conservancy) will provide for an additional $3,000,000 in grant funding to complete the construction of a 3.8-mile segment of the Santa Ana River Trail (SART) Phase III project from Waterman Avenue in the City of San Bernardino to California Street in the City of Redlands for a new not to exceed amount of $6,909,425.

 

BACKGROUND INFORMATION

In 2006, California voters passed the Safe Drinking Water, Water Quality and Supply, Flood Control, River and Coastal Protection Act of 2006 (Proposition 84). This act authorized $45 million in general obligation bonds for the entire SART (which crosses through three counties). The Conservancy was authorized by the State Resources Agency to administer these funds.

 

On August 25, 2015 (Item No. 50), the Board of Supervisors (Board) approved Grant Agreement No. 15-579 (State Agreement No. 15-009) (Agreement) in the amount of $3,399,500 for the construction of a 3.8-mile segment of the Santa Ana River Parkway Trail corridor from Waterman Avenue, in the City of San Bernardino, to California Street, in the City of Redlands with a required completion date of September 30, 2017.  The Board also adopted Resolution No. 2015-168 authorizing the Chief Executive Officer or the Director of Regional Parks to execute all documents in relation to the acceptance and implementation of the Agreement and any subsequent non-substantive amendments, as required by the State, on behalf of the County. 

 

On September 12, 2017 (Item No. 62), the Board approved Amendment No. 1 to the Agreement which extended the project completion date from September 30, 2017 to September 30, 2018, with no changes to the total amount of $3,399,500.

 

On October 2, 2018 (Item No. 19), the Board approved Amendment No. 2 to the Agreement, extending the project completion date from September 30, 2018 to December 30, 2020, with no changes to the total amount of $3,399,500.

 

On November 19, 2019 (Item No. 31), the Board approved Amendment No. 3 to the Agreement, increasing it by $509,925, for a new total of $3,909,425, with no changes to the project completion date of December 30, 2020. 

 

On May 18, 2021 (Item No.71), the Board approved Amendment No. 4 to the Agreement, extending the completion date from December 30, 2020 to February 28, 2025, with no changes to the total amount of $3,399,500.

 

On October 4, 2022 (Item No. 44), the Board accepted $3,000,000 in funding augmentation from the Conservancy to complete Phase III of the SART, which would increase the Agreement by $3,000,000, for a new total of $6,909,425, with no changes to the project completion date of February 28, 2025. This item also authorized the Chief Executive Officer, Deputy Executive Officer of the Community Service Group, or the Director of Regional Parks to execute Amendment No. 5 to the Agreement for this additional funding, following review by County Counsel. On May 2, 2023, Amendment No. 5 to the Agreement was sent by the Conservancy to the Chair of the Board and was executed without review by County Counsel.  Approval of this item will ratify the acceptance and execution of this Amendment by the County.  The SART Phase III project is anticipated to be completed by February 28, 2025. 

 

Approval of this amendment aligns with County and Chief Executive Officer goals and objectives by allowing the Department to collaborate directly with local governments and to seek funding to assist with the continued development of the SART.
