RECOMMENDATION(S)
Recommendation
1. Approve a budget increase of $55,000 to Capital Improvement Program Project No. 23-095 (WBSE 10.10.1402), from $803,782 to $858,782, for the Mojave Narrows Regional Park Dry Campsite Path of Travel Project in Victorville.
2. Authorize the Auditor-Controller/Treasurer/Tax Collector to post the necessary budget adjustments within the Capital Improvement Program, as detailed in the Financial Impact section (Four votes required).
3. Approve the following addenda to the bid documents for the Mojave Narrows Regional Park Dry Campsite Path of Travel Project in Victorville:
a. Addendum No. 1, dated October 4, 2023, revised the mandatory pre-bid meeting date.
b. Addendum No. 2, dated October 18, 2023, added STK Architectural Drawings titled “Mojave Narrows Regional Park Dry Campsite Americans with Disabilities Act Restroom” to the bid documents.
c. Addendum No. 3, dated November 9, 2023, revised the Instruction to Bidders, the Construction Drawings, and clarified contractor’s questions.
4. Find the bid proposal from Leonida Builders, Inc. to be nonresponsive for failing to include a non-collusion affidavit as required by Public Contract Code section 7106.
5. Find the bid proposal from Cornerstone Construction Company to be nonresponsive for failing to acknowledge Addendum No. 3 as required by the bid documents.
6. Award a construction contract in the amount of $313,458 to KNC Construction, Inc., for a contract period of 180 calendar days from the date of the issuance of the Notice to Proceed for the Mojave Narrows Regional Park Dry Campsite Path of Travel Project in Victorville.
7. Authorize the Director of the Project and Facilities Management Department to order any necessary changes or additions in the work being performed under the contract for a total amount not to exceed $28,173 pursuant to Public Contract Code Section 20142.
8. Authorize the Director of the Project and Facilities Management Department to accept the work when 100% complete and execute and file a Notice of Completion.

FINANCIAL IMPACT
Approval of this item will result in the use of Discretionary General Funding (Net County Cost). The 2023-24 Recommended Budget sets aside $30,000,000 in Discretionary General Funding to the Community Service Upgrades Reserve Fund (Reserve) to fund large scale investments in Regional Parks for future revenue generation.
The Regional Parks Department (Department) is requesting the use of reserves in the amount of $55,000 from the Reserve for the project budget increase to the Mojave Narrows Regional Park Dry Campsite Path of Travel Project (Project). As the bids received were higher than anticipated, the requested increase is needed to offset the difference between the lowest responsive bid and the Phase II Project budget. BACKGROUND INFORMATION
The San Bernadino County Regional Parks Department operates camping facilities at Mojave Narrows Regional Park located in Victorville. However, Mojave Narrows Regional Park lacked Americans with Disabilities Act (ADA) accessible dry campsites, and restroom and shower facilities close to the dry campsites. In order to address the lack of the ADA accessible facilities, the Project and Facilities Management Department (PFMD) constructed two ADA accessible campsites including picnic tables, grills, fire pits, waste/recycling receptacle, fencing, parking, and signage under Phase I of the Project. Phase I of the Project was completed in April 2023 using the Job Order Contracting Program.
Approval of the Recommendations will allow PFMD to proceed with the construction of Phase II of the Project. Under Phase II, a new ADA compliant prefabricated restroom and shower facility, drinking fountain, parking and crosswalk will be installed, as well as all associated grading and utilities installation. This Project supports the Board of Supervisors (Board) and Chief Executive Officer goal to improve government operations and provide for the safety, health and social service needs of County residents.
On September 12, 2023 (Item No. 37), the Board determined the Project to be categorically exempt from further review under Section 15301(c) and (d), Class 1, existing structures, and Section 15303(e), Class 3, construction of new, small facilities and accessory structures, of the California Environment Quality Act Guidelines (Title 14, California Code of Regulations). These exemptions apply to Phase I conversion of two existing dry campsites into two ADA accessible campsites and Phase II path of travel, and installation of a new 323 square foot prefabricated combination restroom and shower facility, electrical, sewer, water connections, sewer manhole, and a four-stall parking area.
This Project is consistent with County Administrative Office approved Capital Improvement Program Project No. 23-095.
PROCUREMENT
On September 12, 2023 (Item No. 37), the Board authorized PFMD to advertise for competitive bids. PFMD advertised for bids on September 16, 2023, in the Daily Press, six plan rooms, and on the County Electronic Procurement Network (ePro). On October 17, 2023, nine contractors attended a mandatory job walk.
During the procurement process, the following addenda to the bid documents were issued:
• On October 4, 2023, Addendum No. 1 was issued to revise the mandatory job walk date, pre-bid questions deadline, and bid opening date.
• On October 18, 2023, Addendum No. 2 was issued to update the Construction Drawings.
• On November 9, 2023, Addendum No. 3 was issued to revise the Construction Drawings and provide clarification to contractor’s questions.
