RECOMMENDATION(S)
Recommendation
1. Acting as the governing body of San Bernardino County:
a. Approve an allocation of $220,000 from the Fifth District’s Board of Supervisors operating budget to the Bloomington Recreation and Park District for the Kessler Park Statues Project.
b. Approve contract with the Bloomington Recreation and Park District to provide funding for the Kessler Park Statues Project, in the amount of $220,000, for the contract term of December 17, 2024 through December 31, 2025.
c. Authorize the Auditor-Controller/Treasurer/Tax Collector to post the necessary budget adjustments, as detailed in the Financial Impact section, to provide funding for the Kessler Park Statues Project (Four votes required).
2. Acting as the governing body of Bloomington Recreation and Park District:
a. Approve the Capital Improvement Program - Kessler Park Statues Project, in the amount of $270,000.
b. Approve contract with San Bernardino County for Bloomington Recreation and Park District to receive funding for the Kessler Park Statues Project, in the amount of $220,000, from Fifth District’s Board of Supervisors operating budget for a contract term of December 17, 2024 through December 31, 2025.
c. Authorize the Auditor-Controller/Treasurer/Tax Collector to post the necessary budget adjustments as detailed in the Financial Impact section, for the Kessler Park Statues Project (Four votes required).

FINANCIAL IMPACT
Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). The recommended contract will be funded by the Fifth District’s Board of Supervisors operating budget for 2023-24 and 2024-25.
The total estimated cost of the Kessler Park Statues Project (Project) is $270,000. This item allocates $220,000 from the Fifth District’s Board of Supervisors 2024-25 operating budget for the Project, with the remaining $50,000 already funded using available reserves in the Bloomington Recreation and Park District - Capital Improvement Program (CIP) fund, which was funded by a $50,000 transfer from the Fifth District’s Board of Supervisors operating budget in 2023-24.

Sufficient appropriation for the Project will be included in future recommended budgets, as needed.
BACKGROUND INFORMATION
The recommended contract will assist the Fifth District Supervisor with the public purpose of providing for the public health, recreation, welfare, and social needs of county residents. It also aligns with the Countywide vision by installing two statues at the entrance of the main Kessler Park corridor. These statues, portraying a boy baseball player and a girl softball player, will promote community pride and unity, particularly among local athletic leagues who use the park as their home field.
The Chief Executive Officer, at the direction of the Supervisor of the respective district that the contract serves, may extend the term of the contract, in writing, under the following conditions:
a. In aggregate all extensions do not exceed 12 calendar months;
b. Is specifically requested by the Contractor;
c. Will not change the project goals or scope of services;
d. Is in the best interest of the County and Contractor in performing the scope of services under the contract; and
e. Does not alter the amount of compensation under the contract.
