RECOMMENDATION(S)

Recommendation

1.                     Find that, pursuant to California Government Section 25526.6, a one-year revenue use permit, commencing and retroactive to July 23, 2021 through July 22, 2022, with the County of Riverside, for the use of certain paved portions of the training facilities at the County-owned Emergency Vehicle Operations Center at the Sheriff’s Regional Training Center in the Devore area of San Bernardino, is in the public interest and that the use permit will not substantially conflict or interfere with the County’s use of the property.

2.                     Approve a one-year revenue use permit, commencing and retroactive to July 23, 2021 through July 22, 2022, with the County of Riverside, for the use of certain paved portions of the training facilities at the County-owned Emergency Vehicle Operations Center at the Sheriff’s Regional Training Center in the Devore area of San Bernardino, for minimum revenue in the amount of $12,000.

FINANCIAL IMPACT

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost).  The minimum revenue to be received by San Bernardino County (County) during this one-year use permit agreement is $12,000.  The County will also receive a $96 track maintenance/utility fee per training participant, as reimbursement for the cost of any fuel used by the County of Riverside (Riverside) and reimbursement for the cost of Sheriff/Coroner/Public Administrator (Sheriff) personnel monitoring the training events.  Revenue will be deposited in the Sheriff fund (4439201000).  Annual revenue is as follows:

BACKGROUND INFORMATION

The recommended actions will find and approve  a one-year use permit agreement with Riverside, commencing and retroactive to July 23, 2021 through July 22, 2022, for the non-exclusive use of certain paved portions of the training facilities at the County-owned Emergency Vehicle Operations Center (EVOC), at the Sheriff’s Regional Training Center (SRTC) located at 18958 Institution Road in the Devore area of San Bernardino, for driver training courses of Riverside officers and cadets conducted by Riverside, is in the public interest and will not substantially conflict or interfere with the County’s use of the property.

 

On July 23, 2019, the Board of Supervisors (Board) approved a two-year Use Permit agreement No. 19-506 (Original Permit), for the use by Riverside, of certain paved portions of the training facilities at the County-owned EVOC at the SRTC in the Devore area of San Bernardino.  The Sheriff requested the Real Estate Services Department (RESD) prepare an amendment to the use permit to extend the term of the agreement for Riverside to continue to use the paved portions of the EVOC for driver training courses of Riverside officers and cadets conducted by Riverside.  During negotiations regarding liability releases required by the Sheriff to be included in the agreement, the Original Permit expired; accordingly, a new agreement was then required.  Adjustments were then made by the Sheriff to the reimbursement rates for Sheriff personnel monitoring the training events while the fee for the use of the facility and the $96 track maintenance/utility fee were deemed to be sufficient.  The commencement date of the permit is retroactive to July 23, 2021 to provide for payment of fees during the period between the expiration of the Original Permit and when the new permit is approved and executed by the Board.

 

This new, one-year use permit, commencing and retroactive to July 23, 2021 through July 22, 2022 with Riverside provides for the use of certain paved portions of the training facilities at the County-owned EVOC at the SRTC in the Devore area of San Bernardino for driver training for Riverside officers and cadets to be conducted by Riverside.

 

Staff has reviewed the recommended action pursuant to the California Environmental Quality Act (CEQA) and has determined that it does not constitute a project.  Accordingly, no further action is required under CEQA.

PROCUREMENT

Pursuant to California Government Code Section 25526.6, the Board may grant permits for use of any County property to a state, or county in the manner, and upon the terms and conditions as the Board determines, upon a finding by the Board that the permits are in the public interest and that the permits will not substantially conflict or interfere with the County’s use of the property.
