RECOMMENDATION(S)

Recommendation

Acting as the governing body of the San Bernardino County Flood Control District:

1.                     Rescind Resolution No. 2021-035, adopted on March 23, 2021, that delegated the acceptance of funding from the California State Water Resources Control Board and authorized and designated the San Bernardino County Flood Control District Chief Flood Control Engineer, the Assistant Director of the Department of Public Works, and the San Bernardino County Flood Control District Deputy Director to execute the funding agreement, and any non-substantive amendments related thereto approved by County Counsel, with the California State Water Resources Control Board, and carry out other necessary activities for the Grove Basin Outlet Project.

2.                     Adopt resolution, as required by the California State Water Resources Control Board, authorizing the acceptance of funding from the California State Water Resources Control Board and authorizing and designating the San Bernardino County Flood Control District Chief Flood Control Engineer, the Assistant Director of the Department of Public Works, or the San Bernardino County Flood Control District Deputy Director, or designee(s), to execute the funding agreement, and any non-substantive amendments related thereto approved by County Counsel, with the California State Water Resources Control Board, and carry out other necessary activities for the Grove Basin Outlet Project.

3.                     Direct the San Bernardino County Flood Control District Chief Flood Control Engineer, the Assistant Director of the Department of Public Works, or the San Bernardino County Flood Control District Deputy Director, or designee(s), to transmit the Proposition 1 Storm Water Grant Program grant agreement and related documents to the Clerk of the Board of Supervisors within 30 days of execution.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The San Bernardino County Flood Control District (District) is funded by property tax revenue, fee revenue, and local, state, and federal funding. The California State Water Resources Control Board (Water Board) has awarded a Storm Water Grant to the District in the amount of $4.65 million to partially fund the Grove Basin Outlet Project (Project) cost. The remaining Project cost and 50% grant match requirement will be funded by the District. Adjustments to the District's Zone 1 2020-21 Budget (1910002518) are not requested at this time, but will be included in a future quarterly budget report presented to the Board of Supervisors (Board) for approval, if necessary. Appropriation and revenue will be included in the District’s Zone 1 future recommended budgets.

 

BACKGROUND INFORMATION

The Project is designed to provide 100-year flood protection to residences, businesses, and public infrastructure and will remove the localized floodplain area in the City of Ontario. Secondary benefits of the Project include the potential increase in water supply due to additional recharge capacity and improved water quality due to decreased floodwater contamination. The Project is currently in the design and environmental analysis phase. The District anticipates commencing construction of the Project in the 2023-24 fiscal year.

 

In 2014, Proposition 1 (Assembly Bill 1471) authorized $7.545 billion in general obligation bonds for water projects including surface and groundwater storage, ecosystem and watershed protection and restoration, and drinking water protection. Of the $7.545 billion, Proposition 1 provides $200 million in grant funds for multi-benefit storm water management projects, which may include, but shall not be limited to: green infrastructure, rainwater and storm water capture projects and storm water treatment facilities. The Proposition 1 Storm Water Grant Program funds storm water and dry weather runoff projects that best advance the Water Board's policy goals of improving water quality and realizing multiple benefits from the use of storm water and dry weather runoff as a resource.

 

On February 16, 2021, the District received notification that its application was approved by the Water Board and the District was awarded funding, in the amount of $4.65 million for the construction of the Project. The grant requires a minimum local funding match of 50% of the total Project cost. On March 23, 2021, (Item No. 78), the Board accepted the Proposition 1 grant award (State Agreement No. D2112165) from the Water Board, in the amount of $4,650,000, for the Project and adopted Resolution No. 2021-035 to authorize and designate certain District staff to sign the funding agreement and carry out any other necessary Project activities. The Water Board has since requested a new authorizing Resolution to more broadly delegate such authority as requested by the District.

 

The acceptance of grant funds from the Proposition 1 Storm Water Grant Program to fund part of the Project supports the County’s and Chief Executive Officer’s goals and objectives by creating, maintaining, and growing jobs and economic value in the County as well as operating in a fiscally- responsible and business-like manner by ensuring the development of a well-planned, balanced and sustainable County.
