RECOMMENDATION(S)
Recommendation
1. Approve “In-Kind Use Agreement” contract template for use of the Sheriff/Coroner/Public Administrator Weapons Firing Range, Live Fire House, Explosives/Ordinance Range, Emergency Vehicle Operation Center, Advanced Officer Training, and Training Center to provide use to agencies/instructors for specialized training classes.
2. Approve the use of Sheriff/Coroner/Public Administrator’s training facilities at no charge to agencies/instructors, in exchange for providing student spaces for San Bernardino County Sheriff/Coroner/Public Administrator personnel free of charge.
3. Authorize the Sheriff/Coroner/Public Administrator, or designee, to execute individual agreements, as required.

FINANCIAL IMPACT
Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). This item results in potential cost savings by allowing Contractors to utilize the Sheriff/Coroner/Public Administrator’s (Department) training facilities free of charge in exchange for training slots for Department personnel, reducing the cost of tuition, lodging, meals, and transportation that results from sending employees out of the area for training.
BACKGROUND INFORMATION
The Department’s Weapons Firing Range (WFR) and Live Fire House (LFH) are used on a contractual basis by over 50 local, state, and federal agencies from areas throughout San Bernardino, Riverside, Orange, and Los Angeles Counties in need of periodic firearms qualifications. The LFH is a unique tactical training environment providing realistic hands-on training, using live ammunition, in real life scenarios. In addition, the Department’s Emergency Vehicle Operation Center (EVOC) is used by approximately 60 law enforcement and government agencies in need of training and improved driving skills. The Department’s WFR, LFH, and EVOC are the most beneficial place for Department employees and other agency students to complete necessary periodic firearms training, chemical agent use qualifications, and driving skills.
Many agencies/instructors offer specialized training, some on a one-time basis, that are beyond the scope of periodic tactical and qualification requirements of Department personnel. These courses are in high demand and offer advanced techniques and training to better prepare law enforcement officers for unique situations. Many of these courses are taught by former Special Forces members and other highly trained instructors.
The “In-Kind Use Agreement” will enable these agencies/instructors to utilize the Department’s training facilities free of charge in exchange for providing Department personnel reserved student slots in these high demand specialized training classes at no cost to the Department. A written agreement is necessary to ensure proper liability coverage, cost recovery, and operating procedures between parties.
On April 28, 2009 (Item 28), the Board of Supervisors (Board) approved the “In-Kind Use Agreement” contract template for use of the Range, LFH, and EVOC to provide use to agencies/instructors for specialized classes. This updated “In-Kind Use Agreement” expands the specialized training opportunities to the Department’s Explosives/Ordinance Range, Advanced Officer Training (AOT), and Training Facility to improve Department operations.
Any agreement for in-kind use of the WFR, LFH, Explosives/Ordinance Range, EVOC, AOT, and Training Facility that differs from the standard agreement or exceeds a three-year term will be submitted to the Board for approval. Agreements will be in effect for the specific day(s) of each training class and provide for termination upon 30 days’ written notice.
