Recommendation

Approve Amendment No. 1 to Cooperative Agreement No. 19-468 (Funding Agreement No. 19-1002202) with the San Bernardino County Transportation Authority for Plans, Specifications,  Estimate, Right-of-Way, and Construction phases of the Rock Springs Road Over the Mojave River Project in the Apple Valley area, to increase the project funding amount by $7,028,567, from $20,234,837 to $27,263,404, of which the County is responsible for $3,593,215, update Attachments A and B of the Funding Agreement, allow for the submission of electronic copies of signed invoices for reimbursement of eligible project expenses, and extend the agreement term by four years, for a new term of August 12, 2019 to December 31, 2028.

FINANCIAL IMPACT

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). The Rock Springs Road Over the Mojave River in the Apple Valley area (Project) is increasing by an estimated amount of $7,028,567. The increase will be shared between the County, San Bernardino County Transportation Authority (SBCTA), and the State of California Department of Transportation (State) Federal Highway Bridge Program (HBP).

 

The County’s estimated increase of $3,593,215 will be financed by its Local Measure I revenues and Regional Transportation Development Mitigation Plan (RDMP) fees collected for the Victor Valley Sphere of Influence. The SBCTA’s estimated increase of $2,522,805 will be financed by the Measure I 2010-2040 Victor Valley Subarea Major Local Highway Projects Program (MLHP) revenues and/or other sources under its control. The Department will submit an HBP Project Cost Change Request to the California Department of Transportation (Caltrans) for the remaining $912,547 in HBP funding. Sufficient appropriation and revenue are included in the Department of Public Works (Department) 2023-24 Road Operations budget and will be included in future recommended budgets. With the mentioned increases the parties amended Project costs are as follows:

BACKGROUND INFORMATION

On July 9, 2019 (Item No. 32), the Board of Supervisors (Board) approved Cooperative Agreement No. 19-468 (Funding Agreement No. 19-10022002) with SBCTA authorizing the County to receive reimbursement in an amount not-to-exceed $1,456,938 from SBCTA for the Projects Plans, Specifications, Estimate, Right-of-Way, and Construction phases of the Project. The Project consists of replacing the existing low-water crossing bridge on Rock Springs Road over the Mojave River with a two-lane bridge. The bridge links the Town of Apple Valley and the City of Hesperia, and because at times a storm may cause water to overflow the existing box culverts connected to the bridge, the road/bridge must be closed. The Project will construct a higher-level bridge to mitigate the water overflow.

 

The Project is currently in the design phase. During the design phase process, it was determined that additional intersection improvements, along with curb and gutters, are needed for the Project, which resulted in the Project cost increase along with the increase in material costs. The Project’s construction phase is anticipated to commence in spring 2025.

 

Pursuant to Amendment No. 1 to County Contract No. 19-468 (Funding Agreement No. 10022002) the estimated Project cost increase of $7,028,567 will be funded with County, SBCTA and federal revenues, as specified in the updated Attachment B of the Amended Funding Agreement. Additionally, Amendment No. 1 updates Attachment A - Project Milestone, allows for the submission of electronic copies of signed invoices for reimbursement of eligible project expenses, and extends the term by four years, for a new term of August 12, 2019 to December 31, 2028.

 

Approval of this item aligns with the County and the Chief Executive Officer’s goals and objectives by working cooperatively with the SBCTA in securing necessary funds to proceed with the Project and as well as improving traffic movement along the Rock Springs Road.

 

This Amendment was approved by the SBCTA Board of Directors on December 6, 2023.
