RECOMMENDATION(S)
Recommendation
Acting as the governing body of the San Bernardino County Fire Protection District, terminate the finding first made by the San Bernardino County Fire Protection District Board of Directors on May 20, 2025, that there was substantial evidence that found the termination of the agreement between Buckskin Fire District and the San Bernardino County Fire Protection District created an emergency pursuant to Public Contract Code section 22035 and 22050, requiring immediate action to prevent or mitigate the loss or impairment of life, health, property and essential public services.

FINANCIAL IMPACT
The action to terminate this emergency will not require the use of Discretionary General Funding (Net County Cost) as the Fire Station 21 Modular Acquisition Project (Project) (WBSE 10.10.1850) budget of $1,033,215 was funded with available reserves from the San Bernardino County Fire Protection District’s (SBCFPD) South Desert Regional Service Zone. As part of Project closeout, a $45,000 credit was received from West Coast Renovations and Improvements, Inc. (WCR), reducing their original contract value to a total revised contract value of $362,049 which includes an allowance of $20,000 for installation of the generator transfer switch.
BACKGROUND INFORMATION
The SBCFPD had an agreement in place with the Buckskin Fire District to provide public safety services in the area. Despite negotiations that SBCFPD had hoped would result in continuing services from Buckskin Fire District, ultimately no agreement was reached between the two entities, resulting in services ending on June 30, 2025. To ensure a continuity of life saving services, beginning July 1, 2025, SBCFPD has assigned personnel to continue services in the area. The current station is inadequate for fire service operations due to lack of lodging and showers, so a modular building was needed to support operations. The new modular building houses staff for one engine company and has accommodations of three bedrooms and two offices.
On May 20, 2025 (Item No. 102), the SBCFPD’s Board of Directors (Board) found there was an emergency, pursuant to Public Contract Code sections 22035 and 22050 and authorized the Purchasing Agent to issue purchase orders necessary to the project at 52874 Parker Dam Road in Earp, thus mitigating the risk of loss to health, property, and essential services.
Further, the Board adopted Resolution No. 2025-109 authorizing the Purchasing Agent, as directed by the Chief Executive Officer (CEO), to direct the purchasing agent to issue purchase orders and/or execute contracts, for a total amount not-to-exceed $1,033,215, for any emergency remediation, construction, installation, and modifications of internal and external structures related to the Project.
On June 11, 2025, WCR mobilized for construction on the utility infrastructure in preparation for delivery of the modular building to site. The modular building was installed by CSLM Construction Inc. (CSLM) by the third week of June, and the utility infrastructure connecting the Fire Station 21 building to the modular structure was replaced and upgraded. Final correction items were completed by September 2025.
The Project and Facilities Management Department (PFMD) retained contractors who have completed the emergency work required to complete the required modular building acquisition and installation, including utilities infrastructure connections. A termination of the emergency finding is recommended in accordance with Government Code sections 22050 and 22035, as the project has been completed.
No further projects are necessary to address the effects of the emergency due to the recommended termination of this emergency.
PROCUREMENT
On May 20, 2025, PFMD prepared a scope of work and obtained quotes from CSLM and WCR.
On June 12, 2025, the Purchasing Agent, through delegated authority from the CEO, issued a purchase order/contract to two contractors. The first contract (Contract No. 4400028579) was to CSLM in the amount of $289,352 for the purchase and installation of a modular building. The second contract (Contract No. 4400028617) was to WCR in the amount of $482,504, including an allowance of $109,904, for infrastructure utility connections to the modular building. WCR completed their scope of work with a reduction to their original contract value in the amount of $45,000 for a total revised contract value of $362,049 which includes an allowance of $20,000 for installation of the generator transfer switch.
On September 30, 2025, the Purchasing Agent, through delegated authority from the CEO, issued Amendment No. 1 to Contract No. 4400028579 with CSLM, in the amount of $24,516.29, increasing the total contract amount from $289,352 to $313,868.29, for the removal of two 3.5-ton HVAC units, and the purchase and installation of two new 4-ton HVAC units needed to adequately cool the refurbished modular building.
