Recommendation

Approve non-financial Memorandum of Understanding between the Probation Department, Sheriff/Coroner/Public Administrator, District Attorney’s Office, Public Defender’s Office, Department of Children and Family Services, Department of Behavioral Health, San Bernardino County Superintendent of Schools, and the City of Redlands Police Department, to set forth agency roles and responsibilities  under the Juvenile Justice Crime Prevention Act program, for a term of January 15, 2025, through January 14, 2030.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost).  This Memorandum of Understanding (MOU) is non-financial in nature as it sets forth the roles and responsibilities for existing Juvenile Justice Coordinating Council member agencies. To the extent the Council votes to disburse Juvenile Justice Crime Prevention Act funding, the Probation Department, as the Juvenile Justice Coordinating Council Chair, will return to the Board of Supervisors for approval of related budget adjustments, as needed. 

 

BACKGROUND INFORMATION

Government Code section 30061 and Welfare and Institutions Code (WIC) section 1961, as amended by Assembly Bill 1998 (Ch. 880, Statutes of 2016), combined and established the planning and reporting requirements under the Juvenile Justice Crime Prevention Act (JJCPA) and the Youthful Offender Block Grant (YOBG) programs. WIC section 749.22 also mandates the establishment of a Juvenile Justice Coordinating Council (JJCC). All parties to this MOU are board members of the JJCC, with the Probation Department’s Chief Probation Officer as the JJCC Chair.

 

The JJCPA program provides state funding for counties to implement programs that have proven effective in reducing crime and delinquency among at-risk youth and youthful offenders.

 

The YOBG program provides state funding for counties to deliver custody and care (i.e., appropriate rehabilitative and supervisory services) to youthful offenders who previously would have been committed to the California Department of Corrections & Rehabilitation, Division of Juvenile Justice.

 

The combined JJCPA-YOBG program has specific reporting requirements to the Office of Youth and Community Restoration (OYCR) including an annual JJCPA-YOBG operational plan (due annually by May 1) that combines all required programs, placements, strategies, services, and systems information into one consolidated document; and an annual JJCPA-YOBG Grant Expenditure and Data Report that provides expenditure detail for both JJCPA and YOBG as well as specified countywide  juvenile offender data (due annually by October 1).

 

In preparation for the 2024-25 budget, the JJCC voted unanimously to appropriate JJCPA reserve balances in the upcoming and subsequent fiscal years toward new program developments that would include, wherever possible, collaborations between the agency partners and local Community Based Organizations. This action necessitated the established operational guidelines and agreements outlined in this MOU.

 

The recommended MOU is a non-financial agreement that outlines the shared obligations of each of the participating agencies under the JJCPA and WIC section 16521.6, including but not limited to commitment to developing and implementing a continuation of countywide responses to juvenile crime. The MOU also enhances the existing interagency collaboration and partnership through increased coordination in the delivery of services to provide prevention, intervention, and re-entry services to serve at-risk and system involved youth and their families.
