RECOMMENDATION(S)

Recommendation

1.                     Acting as the governing body of San Bernardino County, approve contracts with the following contractors to perform on-call professional storm water pollution prevention plan services from April 7, 2026, to April 6, 2031, in an amount not to exceed $1,000,000 for each contract:

a.                     Apex Companies, LLC

b.                     CG Resource Management and Engineering Inc.

c.                     CWE

d.                     Ninyo & Moore Geotechnical & Environmental Sciences Consultants

e.                     TRC Solutions, Inc.

2.                     Acting as the governing bodies of the San Bernardino County Service Areas and their Zones, the Big Bear Valley Recreation and Park District, and the Bloomington Recreation and Park District, approve joint contracts with the following contractors to perform on-call professional storm water pollution prevention plan services from April 7, 2026, to April 6, 2031, in an amount not to exceed $1,000,000 for each contract:

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The aggregate not to exceed amount of these contracts is $10,000,000 for the contract term of April 7, 2026, through April 6, 2031. The County Service Area and their Zones (CSAs), Big Bear Valley Recreation and Park District (BBVRPD), and the Bloomington Recreation and Park District (BRPD) will fund the cost of these contracts as the services are needed. Adequate appropriation for these services is included in the respective 2025-2026 budgets for the CSAs, BBVRPD, and BRPD, and will be included in future recommended budgets.

 

BACKGROUND INFORMATION

The Department of Public Works - Special Districts (Department) administers the CSAs, BBVRPD, and BRPD, which at times require professional stormwater pollution prevention plan services. A stormwater pollution prevention plan is a site-specific document that identifies potential sources of water pollution and outlines the strategies, practices, and controls a facility or construction site will use to prevent those pollutants from entering local water bodies through stormwater runoff. The ability to have qualified consultants available to provide these services greatly enhances and expedites the Department’s capability to respond to these needs.

 

Approval of this item will allow for the use of on-call professional storm water pollution prevention plan services on an as-needed basis for the CSAs, BBVRPD, and BRPD. The recommended contracts will provide readily available on-call professional stormwater pollution prevention plan services from pre-approved companies to enhance work efficiencies. Workloads and assignments to the on-call consultants will be based on availability, responsiveness, and expertise in areas of particular need on an as-needed and project-by-project basis that will be solicited by the Department and then memorialized in a purchase order. The term of these contracts is for five years but may be terminated for convenience upon 30 days’ written notice.

 

PROCUREMENT

On November 6, 2025, the Department released Request for Proposal (RFP) No. SPD126-SPDAD-6116 on the County’s Electronic Procurement System (e-Pro) inviting proposals from interested and qualified agencies to provide on-call professional storm water pollution prevention plan services for County and Special District projects for a period of five years.

 

Eight proposals were received by the established deadline in response to the RFP:

The evaluation panel, which included representatives from the Department, reviewed and evaluated the proposals using the criteria listed in the RFP and which included qualifications and experience, technical review, and references.

 

After completion of the evaluation and ranking of the proposal responses, the Department is recommending awarding on-call professional stormwater pollution prevention services agreements to the five highest ranked consultants, as detailed in the recommendations, to provide the professional services to the County, CSAs, BBVRPD, and BRPD on an as-needed and as-requested basis. Award letters were sent to all responsible and responsive proposers on February 3, 2026. No protests were received within the allowable period.
