Recommendation

Approve Amendment No. 5 to Agreement No. 09-429 with Kern County for Kern County to continue to accept residential solid waste from the San Bernardino County communities of Four Corners, Red Mountain, and Windy Acres, for disposal at the Ridgecrest Sanitary Landfill and Randsburg Transfer Station, at a cost of $34,506.24 for 2024-25, to be adjusted each year based on Kern County’s disposal fees, extending the term for five years, for a total term of July 1, 2009 through June 30, 2029.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost) as the Department of Public Works - Solid Waste Management Division (SWMD) is financed by fee revenue. SWMD establishes fees that are charged to the public and other agencies for utilization of the County’s Waste Disposal System. The estimated total cost of this five-year extension is $172,531.20 ($34,506.24 annually), subject to future annual disposal fee rate adjustments approved by the Kern County Board of Supervisors. Sufficient appropriation has been included in the SWMD 2024-25 recommended budget and will be included in future recommended budgets.

 

BACKGROUND INFORMATION

Under the proposed amendment, SWMD will pay $179.72 for each of the 167 improved single-family residential parcels identified in the County Assessor’s records and 25 additional parcels to account for future growth that may require solid waste disposal services for a total annual amount of $34,506.24. San Bernardino County (County) does not operate a solid waste disposal facility within a reasonable distance of the service area. On June 2, 2009 (Item No. 26), the San Bernardino County Board of Supervisors (Board) approved Agreement No. 09-429 (Agreement) with Kern County to facilitate necessary refuse disposal service during the term of July 1, 2009 through June 30, 2012, for these San Bernardino County residents and to minimize operational cost to both counties.  Since the approval of this agreement, the following amendments have been approved by the Board:

 

                     June 28, 2011 (Item No. 91), the Board approved Amendment No. 1 to the Agreement to reflect increased disposal costs implemented by Kern County.

                     June 5, 2012 (Item No. 56), the Board approved Amendment No. 2 to extend the term of the Agreement by five years through June 30, 2017.

                     June 13, 2017 (Item No. 69), the Board approved Amendment No. 3 to extend the term of the Agreement by an additional five years through June 30, 2022.

                     May 24, 2022 (Item No. 81), the Board approved Amendment No. 4 to extend the Agreement by an additional two years through June 30, 2024, to allow SWMD to thoroughly assess potential cost implications and explore alternative solutions.

 

SWMD has concluded that a continuation of the current Agreement is necessary as the County does not operate a solid waste disposal facility within a reasonable distance of the service area. Therefore, SWMD recommends extending the Agreement by an additional five years through June 30, 2029, to ensure uninterrupted waste disposal services for county residents.
