RECOMMENDATION(S)
Recommendation
1. Approve Addendum No. 1, issued on July 29, 2024, to the bid documents for the Dola Ditch and Lanzit Ditch Bridge Replacement Project on National Trails Highway in the Amboy area.
2. Award a construction contract to MWC Group, Inc., in the amount of $5,549,262.02 for the Dola Ditch and Lanzit Ditch Bridge Replacement Project on National Trails Highway in the Amboy area.
3. Authorize a contingency fund of $554,926 for the Dola Ditch and Lanzit Ditch Bridge Replacement Project on National Trails Highway in the Amboy area.
4. Authorize the Director of the Department of Public Works to approve the expenditure of the contingency fund of $554,926 for verified quantity overruns for this unit priced construction contract.
5. Authorize the Director of the Department of Public Works to order any necessary changes or additions in the work being performed under the contract for a total amount not to exceed $210,000 of the $554,926 contingency fund, pursuant to Public Contract Code section 20142.
6. Authorize the Director of the Department of Public Works to accept the work when 100% complete and execute and file the Notice of Completion.

FINANCIAL IMPACT
Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). The Dola Ditch and Lanzit Ditch Bridge Replacement Project on the National Trails Highway in the Amboy area (Project) is funded by the Department of Public Works (Department) existing allocation of Discretionary General Funding for projects on the National Trails Highway. Sufficient appropriation and revenue are included in the Department’s Road Operations budget (6650002000 12H15220).
BACKGROUND INFORMATION
The Project involves the replacement of two timber trestle bridges, known as the Dola Ditch Bridge and the Lanzit Ditch Bridge, with new concrete bridges. These bridges are located at National Trails Highway, otherwise known as United States Highway 66 and traditionally known as Route 66. The Dola Ditch Bridge and Lanzit Ditch Bridge are approximately 2.08 miles and 2.77 miles, respectively, east of Kelbaker Road in the unincorporated community of Amboy.
The Project consists of removing the existing timber trestle bridges and constructing new concrete bridges, rock slope protection, guardrails, and roadway reconstruction. In the interest of public safety, the road is closed to traffic and will remain closed for the duration of the Project. Appropriate measures will continue to take place to notify surrounding businesses and residences of the road closure and detour. All work for the Project will be done within the existing right-of-way and additional right-of-way will not need to be acquired.
The Project aligns with the County and the Chief Executive Officer’s goals and objectives by constructing new bridges along this historically significant highway, which improves access to both the Interstate 15 and Interstate 40 highways, thus creating, maintaining, and growing jobs and economic value in the County.
On April 19, 2016 (Item Nos. 50 and 51), the Board of Supervisors (Board) adopted the Mitigated Negative Declarations for the Project, approved the Notices of Determination, and directed the Clerk of the Board to file and post said notices fulfilling the County’s obligation under the California Environmental Quality Act.
Following Board approval of this item, construction is anticipated to commence in October 2024 and be completed by April 2025.
PROCUREMENT
On February 27, 2024 (Item No. 46), the Board approved the Project’s plans and specifications, as well as authorized the Director of the Department to advertise the Project for bids. This Project was advertised in Mohave Valley Daily News on July 3, 2024 and July 10, 2024, in the San Bernardino County Sun on July 2, 2024, and released on the County electronic procurement network (ePro) on July 2, 2024. Notice inviting bids was also provided to specified construction trade journals as required by Public Contract Code section 22036. On August 1, 2024, the following four bids were received:

The Department has reviewed the bids received and determined that they are responsive, and recommends entering into a contract with MWC Group, Inc., the responsive lowest responsible bidder. No appeal/protest letters were received.
This Project will have a 10 percent contingency fund of $554,926 to compensate the contractor for verified quantity overruns, as well as changes in the contract under certain circumstances. Under an established formula based on the contract amount, Public Contract Code section 20142 allows the Board to authorize the Director of the Department to order changes in the contract, including for unforeseen conditions or design shortfalls, should they become necessary in the future, for a total amount not to exceed $210,000 of the $554,926 contingency fund.
