RECOMMENDATION(S)

Recommendation

Acting as the governing body of the San Bernardino County, Board Governed County Service Areas, San Bernardino County Flood Control District, Big Bear Valley Recreation and Park District, Bloomington Recreation and Park District, In-Home Supportive Services Public Authority, Inland Counties Emergency Medical Agency, and the San Bernardino County Fire Protection District, approve and adopt a Resolution to accommodate and accept facsimile and digital signatures.

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost).

 

BACKGROUND INFORMATION

On April 21, 2020 (Item No. 29), the Board of Supervisors approved Resolution No. 2020-030 to allow the County to accommodate and accept facsimile and digital signatures in order to process official documents during the COVID-19 pandemic.  On March 1, 2022 (Item No. 72), following termination of the local emergency related to the COVID-19 pandemic, the Board of Supervisors/Board of Directors (Board) approved and adopted Resolution No. 2022-40, authorizing continued use of facsimile and digital signatures through May 31, 2022.

 

The County and Board governed entities have utilized facsimile and digital signatures successfully for the last two years and are currently in the process of drafting and submitting to the Board for approval a County Policy on the use of electronic signatures. As development of this County Policy is still in process, the recommended Resolution will allow for the continued use of facsimile and digital signatures through December 31, 2022, or the Board’s approval of a County Policy on electronic signatures, whichever occurs first.

 

The new Resolution will continue to allow the use of the facsimile or digital signature of the Chairman of the Board for use on all copies of resolutions, orders, ordinances, letters, contracts, minutes, and records of the Board upon which the Chairman has been authorized, empowered, or instructed to sign by resolution of the Board, or by ordinance or statute. This Resolution also accommodates electronic and digital signature per Civil Code sections 1633.1-1633.17, subject to requirements under Government Code section 16.5 et. seq. and Title 2, Division 7, Chapter 10 of the California Code of Regulations.
