RECOMMENDATION(S)
Recommendation
Acting as the governing body of the San Bernardino County Flood Control District:
1. Approve Addendum No. 1, issued on March 9, 2026, and Addendum No. 2, issued on March 12, 2026, to the bid documents for the Grove Basin Outlet Drain Project in the City of Ontario.
2. Consent to the withdrawal of bid by WEKA, Inc., due to a material written error in its bid, as allowed under Public Contract Code sections 5101 and 5103.
3. Award Construction Contract to Mamco, Inc. dba Alabbasi, in the amount of $12,777,777 for the Grove Basin Outlet Storm Drain Project in the City of Ontario.
4. Authorize a contingency fund of $1,277,777 for the Grove Basin Outlet Storm Drain Project in the City of Ontario.
5. Authorize the Chief Flood Control Engineer of the San Bernardino County Flood Control District to approve the expenditure of the contingency fund of $1,277,777 for verified quantity overruns for this unit priced construction contract.
6. Authorize the Chief Flood Control Engineer of the San Bernardino County Flood Control District to order any necessary changes or additions in the work being performed under the contract for a total amount not to exceed $150,000 of the $1,277,777 contingency fund, pursuant to Public Contract Code section 21061(d).
7. Authorize the Chief Flood Control Engineer of the San Bernardino County Flood Control District to accept the work when 100% complete and execute and file the Notice of Completion.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The Grove Basin Outlet Drain Project in the City of Ontario (Project) is partially funded with a state grant of $4,650,000; the remainder of the Project is funded by property tax revenue. Sufficient appropriation and revenue for the Project have been included in the Flood Control District (District) 2025-26 budget (1910002518 F02650).
BACKGROUND INFORMATION
The Project consists of constructing approximately 1.24 miles of reinforced concrete pipe storm drain along Grove Avenue, from Grove Basin Outlet to Edison Avenue within the City of Ontario (City). The downstream area of the basin currently experiences flooding, affecting mainly low-density residential and agricultural areas. With rapid regional development consistent with the City’s master plan, increasing the hydrologic demand, construction of the Project will help alleviate associated flooding impacts.
On September 23, 2025 (Item No. 98), in compliance with the California Environmental Quality Act (CEQA), the Board of Supervisors (Board) adopted a Mitigated Negative Declaration and a Notice of Determination for the Project. Based on the environmental review and coordination with resource agencies, it was determined that no regulatory permits were required for this Project. No timely CEQA challenge was filed against the Project.
This Project will have a 10 percent contingency fund of $1,277,777 to compensate the contractor for verified quantity overruns, as well as changes in the contract under certain circumstances. Under an established formula based on the contract amount, Public Contract Code section 21061(d) allows the Board to authorize the Chief Flood Control Engineer to order changes in the contract, including for unforeseen conditions or design shortfalls, should they become necessary in the future, for a total amount not to exceed $150,000 of the $1,277,777 contingency fund.
Following Board approval of this item, construction is anticipated to commence May 2026 and be completed by November 2026, with a construction completion date of 120 working days from the date of issuance of the Notice to Proceed for the Grove Basin Outlet Storm Drain Project in the City of Ontario.
PROCUREMENT
On January 28, 2026, pursuant to County Policy No. 11-15, the Assistant Executive Officer approved the Project’s plans and specifications, as well as authorized the Chief Flood Control Engineer to advertise the Project for bids. This Project was advertised in the San Bernardino County Sun newspaper on February 10, 2026, and released on the County electronic procurement network (ePro) on February 10, 2026. Notice inviting bids was also provided to specified construction trade journals identified pursuant to Public Contract Code section 22036.
The following addendums were issued during the bidding phase.
Addendum No. 1: Amend Special Provisions, revised contract documents, and answer questions asked by potential bidders.

Upon receipt of the bids, the District determined that the bid submission from CEM Construction Corp. was deemed non-responsive because the proposal was not included. Ferreira’s bid was also deemed non-responsive because the addendum acknowledgements were not included.
On March 23, 2026, the District received a letter from WEKA, Inc., requesting to withdraw its bid, citing a material clerical error in its bid proposal. After careful consideration, the District determined WEKA, Inc. met the requirements under Public Contract Code section 5103 to allow the withdrawal of the bid, specifically, (1) a mistake was made filling out the bid; (2) WEKA, Inc. notified the County of the mistake within five working days of the bid opening; and (3) the mistake materially altered the bid.
The District has reviewed the bids received and determined that the remaining seven bids were responsive, and recommends entering into a contract with Mamco, Inc. dba Alabbasi, the responsive, lowest responsible bidder. No additional appeal/protest letters were received.
