Recommendation
1. Approve Amendment No. 1 to Contract No. 24-690 with Griffith Company, increasing the contract amount by $713,801, from $6,861,100 to $7,574,901, for the additional scope of work, with no change to the construction completion date of September 3, 2025, for the Sheriff/Coroner/Public Administrator’s Emergency Vehicle Operations Center Asphalt and Lighting Replacement Project in San Bernardino (Four votes required).

Approve Change Order No. 1 to Contract No. 24-690 with Griffith Company, increasing the total amount by $371,531, from $7,574,901 to $7,946,432, for additional scope of work, with no change to the construction completion date of September 3, 2025, for the Sheriff/Coroner/Public Administrator’s Emergency Vehicle Operations Center Asphalt and Lighting Replacement Project in San Bernardino (Four votes required).

FINANCIAL IMPACT
Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). The Sheriff/Coroner/Public Administrator’s (Sheriff) Emergency Vehicle Operations Center (EVOC) Asphalt and Lighting Replacement Project (Project) (WBSE 10.10.1222) budget of $14,851,355 is funded by a combination of Discretionary General Funding and Proposition 172 in the amount of $7,961,232 and $6,890,123, respectively, as approved by the Board of Supervisors (Board) on June 11, 2024 (Item No. 110) as part of the 2024-25 Capital Improvement Program budget.
BACKGROUND INFORMATION
Approval of Amendment No. 1 to Contract No. 24-690, in the amount of $713,801, compensates Griffith Company (Contractor) for additional work resulting from unforeseen site conditions and regulatory requirements not included in the original contract scope. The Sheriff’s EVOC Driver Training Facility is located within a designated wildlife habitat that supports the endangered San Bernardino kangaroo rat, requiring strict environmental protection and regulatory compliance. Further, the site lies within the Cajon Wash Lytle Creek Hydrologic Region, an area prone to flooding, erosion, and seismic activity due to natural water flow from Cajon Creek and unstable soil conditions. Excavation and grading revealed unanticipated subsurface degradation, including soil erosion and habitat disruption. To mitigate these issues and comply with directives from the California Department of Fish and Wildlife and the United States Army Corps of Engineers, the Project must now incorporate new drainage improvements, erosion controls, and pavement rehabilitation in critical areas to prevent further environmental damage and preserve sensitive habitat.
Additionally, Kinder Morgan, an energy infrastructure company specializing in the transportation and storage of natural gas and petroleum products, operates underground high-pressure fuel pipelines that run beneath portions of the project site. Due to differing site conditions impacting these fuel lines, Kinder Morgan mandated design revisions to sections of the asphalt pavement to ensure the safety and integrity of their pipeline infrastructure. Approval and oversight from Kinder Morgan are required for any excavation or work performed within designated areas surrounding their pipelines. In addition to these design changes, the scope of work includes new stall striping, lighting upgrades, signage, guard rails, and initial investigations if the railroad lights can be repaired and to determine the feasibility of adding new loops to comply with the 2022 California Building, Electrical, and Energy Codes, as well as Caltrans and Sheriff's safety standards. These items were not included in the original design and specifications.
Approval of Change Order No. 1 (CO1) will increase the contract amount by $371,531 to cover additional work not included in the original contract, due to unforeseen conditions that arose during construction. CO1 includes installing high mast lighting pull boxes, extra striping, realignment of reclaimed water blowoff line, revised parking stall striping, construction of new driveways, a new gate and fence repairs, rock removal, concrete steps, curb extensions, a traffic-rated pull box, relocation of air relief valve, and electrical repairs due to rodent damage and faulty wiring to provide additional safety enhancements. The addition of a new path of travel and concrete sidewalk and ramp are needed to meet Americans with Disabilities Act requirements.
On February 6, 2024 (Item No. 36), the Board authorized the Project and Facilities Management Department to solicit competitive bids for the Project. On July 23, 2024 (Item No. 43), the Board awarded construction Contract No. 24-690 to Contractor in the amount of $6,861,100 with a construction contract completion date of September 3, 2025.
Public Contract Code section 20136 requires all construction contract change orders and amendments to have four vote approval by the Board.
