Recommendation

Approve Amendment No. 1 to Agreement No. 23-189 with ProviderTrust, Inc. for the provision of exclusion screening, license monitoring, and Drug Enforcement Agency monitoring, increasing the total agreement amount by $24,000, from $60,000 to $84,000, and exercising the first of two options to extend the term of the agreement for one additional year, for a total period of March 14, 2023 through March 13, 2027.

FINANCIAL IMPACT

This item does not impact Discretionary General Funding (Net County Cost). The recommended agreement increase of $24,000 is funded by 1991 Realignment. Adequate appropriation and revenue have been included in the Department of Behavioral Health (DBH) 2025-26 budget and will be included in the 2026-27 recommended budget.

 

BACKGROUND INFORMATION

DBH is responsible for providing mental health and substance use disorder (SUD) services to San Bernardino County residents experiencing severe mental illness and/or SUD. Federal and State regulations require DBH to conduct specified employee and affiliated contractor exclusion screenings (for eligibility for participating in Federal or State funding), license monitoring, and Drug Enforcement Administration (DEA) registration monitoring.

 

The DBH Office of Compliance (Compliance) is responsible for ensuring the completion of exclusion screening for over 1,500 DBH workforce members (including volunteers, interns, and students) prior to the start of employment and monthly thereafter; exclusion screening for affiliated contractors prior to contract commencement; and for monitoring of license, registration, and certificate status for all care providers. The exclusion screening, license monitoring, and DEA monitoring provided by ProviderTrust, Inc. (ProviderTrust), allows Compliance staff to perform time-sensitive, mandated activities. Through Amendment No. 1 to Agreement No. 23-189 (Agreement) with ProviderTrust, continued utilization of the services will allow DBH to efficiently and effectively comply with the mandates detailed below:

 

                     Exclusion Screening: Per Title 42 of the Code of Federal Regulations (CFR), Parts 1001 and 1002, 42 CFR §438.610, Social Security Act §1128, DBH shall not hire, contract or utilize the services of any individual or entity identified as excluded or ineligible from participation in Federal or State funding. As previously stated, exclusion screening is required for all workforce members and affiliated contractors.

 

                     License Monitoring: Per 42 CFR § 438.608 and Patient Protection and Affordable Care Act §6401, DBH is responsible for verifying and monitoring DBH service providers who are licensed, registered and/or certified. DBH must also ensure service provider staff are in compliance with respective licensing or certifying board registration requirements. This includes researching license registration and/or certification status through the appropriate licensing and/or certifying board. This also consists of preparing DBH employee and Human Resources expired license, registration, and/or certification notifications as appropriate.

 

                     DEA Registration Monitoring: Per 21 United States Code (U.S.C.) § 822 (a)(2), DEA regulations require every practitioner who prescribes, administers, and/or dispenses any controlled substance must obtain a DEA registration, also referred to as a DEA license. DBH must monitor these registrations to ensure the practitioners are in, and remain in, compliance with these regulations.

 

On March 14, 2023 (Item No. 8), as the result of a formal procurement, the Board of Supervisors approved the Agreement with ProviderTrust for the provision of exclusion screening, license monitoring, and DEA monitoring, in the amount of $60,000, for the period of March 14, 2023 through March 13, 2026, which included an option to renew for two consecutive one-year periods.

 

Approval of this item will allow DBH to continue to operate in an ethical, compliant, and fiscally responsible manner by utilizing the exclusion screening, license monitoring, and DEA monitoring services provided by ProviderTrust rather than a dedicated DBH staff member. The services provided will lead to efficient and effective means to comply with, and document completion of the mandated screenings and monitoring as required by the CFR and U.S.C.
