Acting as the governing body of the San Bernardino County Fire Protection District, approve Revenue Agreement with Henkels & McCoy, Inc. to provide on-site fire protection services during critical infrastructure repair being performed by Henkels & McCoy, Inc. on behalf of Southern California Edison in and around the Mt. Baldy area, at compensation rates as specified in the Agreement, for the period commencing August 25, 2020 through February 28, 2021.

FINANCIAL IMPACT
Approval of this agreement will not result in the use of additional Discretionary General Funding (Net County Cost). The actual cost for the San Bernardino County Fire Protection District (SBCFPD) to provide on-site fire protection services will be determined by amount of actual hours of coverage provided by SBCFPD. Revenue from this agreement will offset the costs incurred by SBCFPD.
BACKGROUND INFORMATION
Henkels & McCoy, Inc. (HM) is a subcontractor for Southern California Edison. HM will be doing critical infrastructure repair in the area of Mt. Baldy, estimated to occur for 30 non-consecutive days, Monday through Friday, 7:00 A.M. to 5:00 P.M. from the effective date of the agreement through November 27, 2020. Because of the scope of work, they are requesting SBCFPD provide on-site fire protection services during the time work is being performed. SBCFPD will receive compensation for services based on Board-approved rates in SBCFPD’s fee ordinance. The term of the agreement is through February 28, 2021, in order for the parties to complete final invoicing and payment. The number of days and the beginning and end date of service are estimated and may be changed or extended by SBCFPD’s Fire Chief, or designee, and an authorized representative of HM through the termination date of the agreement.
HM recognizes that various fire hazards can occur in the operation of the critical infrastructure repair, therefore, they have requested SBCFPD to provide on-site fire protection services on the non-red flag days on which repairs are being made. By entering into this agreement, SBCFPD will be able to provide on-site services for the term of the agreement, which will begin August 25, 2020 through February 28, 2021, but may be terminated without cause by either party with 30 days written notice. The agreement delineates service requirements and corresponding compensation to SBCFPD for personnel and equipment. The agreement also provides the SBCFPD Fire Chief the right to exercise SBCFPD’s authority under the agreement, including the right to give notice of termination
