Approve Amendment No. 1 to Revenue Agreement 20-98 (State Revenue Agreement No. 18-0722-000-SA) with the California Department of Food and Agriculture, Plant Health and Pest Prevention Services/Pest Exclusion Division, to expand the Scope of Work to include registration and renewal issuance activities to be performed by the Department of Agriculture/Weights & Measures on behalf of the State and to increase the revenue agreement by $28,774, for a maximum reimbursement of $30,774, for the period of April 30, 2019 through June 30, 2020.

FINANCIAL IMPACT

This item will not result in the use of additional Discretionary General Funding (Net County Cost). The amended revenue agreement specifies a term from April 30, 2019 through June 30, 2020, and increases the revenue agreement by $28,774 for a revised maximum of $30,774. Appropriation and Revenue associated with this agreement is included in Agriculture/Weights & Measures (AWM) 2019-20 Budget. Services per the revenue agreement will be fulfilled by existing AWM staff.

 

BACKGROUND INFORMATION

This amended revenue agreement with the California Department of Food and Agriculture, Plant Health and Pest Prevention Services/Pest Exclusion Division (CDFA, PHPPS/Pest Exclusion) expands the Scope of Work to include registration and renewal issuance activities related to all approved cultivators, and includes $28,774 in additional funds to reimburse AWM for performing registration and enforcement activities related to the Industrial Hemp Program.

 

AWM will continue to perform activities related to industrial hemp registration, renewal, and registration amendments. This includes the confirmation that applicants submitted all supporting documents as required by CDFA’s guidelines and the requirements outlined in Section 4920, in Title 3 of the California Code of Regulations. In addition, AWM staff will sample for THC levels and review preharvest, harvest, and destruction reports, forwarding the related information to CDFA.

 

This revenue agreement aligns with the County and Chief Executive Officer’s Goals and Objectives to Pursue County Goals and Objectives by Working with Other Agencies with respect to performing enforcement activities for the Industrial Hemp Cultivation Program on behalf of CDFA, PHPPS/Pest Exclusion, and receiving reimbursement for the work performed.

 

The Board first approved the initial revenue agreement with CDFA, PHPPS/Pest Exclusion on March 10, 2020 (Item No. 7), to provide enforcement activities related to the cultivation of industrial hemp, throughout San Bernardino County, on behalf of the State. This amended revenue agreement revises the agreement approved by the Board on March 10, 2020 (Item No. 7).
