Recommendation

1.                     Approve Amendment No. 1 to Agreement No. 23-350 with LPA, Inc., to provide on-call professional architectural services, increasing the total agreement amount by $1,200,000, from $4,000,000 to $5,200,000, with no change to the contract term of May 23, 2023 to May 22, 2028.

2.                     Approve Amendment No. 2 to Agreement No. 23-419 with Terracon Consultants, Inc., to provide on-call professional environmental consulting services, increasing the total agreement by $30,000, from $750,000 to $780,000, with no change to the contract term of May 23, 2023 to May 22, 2028.

FINANCIAL IMPACT

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). The amendments to the agreements with LPA, Inc. and Terracon Consultants, Inc., in the amounts of $1,200,000 and $30,000, respectively, will be fully funded through the Department of Behavioral Health’s (DBH) individual project budgets under the Capital Improvement Program (CIP), as authorized by the Board of Supervisors on June 10, 2025 (Item No. 136).

 

BACKGROUND INFORMATION

Since its inception in July 2005, the on-call consultant process has provided expert architectural, engineering, testing, mechanical/electrical/plumbing engineering, and construction management services for numerous CIP projects. The availability of on-call services has allowed the Project and Facilities Management Department (PFMD) to accelerate the selection of design, engineering, or construction related professional services, resulting in valuable savings of time and cost in the overall design/construction timeline. The on-call consultant process has improved the delivery of much-needed projects. Operationally, the on-call consultant process has been integral in helping PFMD meet the San Bernardino County (County) and Chief Executive Officer’s goals and objectives to improve County government operations and operate in a fiscally responsible and business-like manner by providing savings of time and cost in the overall design and construction timeline of projects.

 

On May 23, 2023 (Item No. 50), as the result of Request for Proposals Nos. ANE223-ANE2C-4789 and ANE223-ANE2C-4786, the Board approved 83 on-call professional services agreements, which included agreements with LPA, Inc. (LPA) and Terracon Consultants, Inc. (Terracon). LPA provides on-call professional architectural services. Terracon provides environmental consulting and geotechnical, materials testing, and inspection services.

 

The recommended increase to the agreements will allow LPA and Terracon to continue to provide these services for multiple CIP projects located at DBH facilities, including, ligature risk requirements, equipment replacements, remodels, fire and life safety assessments, roof replacement, and EPIC network infrastructure.

 

Amendment No. 1 to the agreement with LPA, will increase the total contract amount by $1,200,000, from $4,000,000 to $5,200,000, to allow LPA to continue providing architectural services for active projects they have initiated across multiple DBH facilities. This increase is necessary to ensure continuity of work on grant-funded projects, as the remaining contract balance is insufficient to complete all associated work, risking the loss of critical funding. DBH projects are tied to strict funding and grant-driven milestone deadlines that must be met to receive or retain funding. LPA, having already initiated the design work and possessing detailed knowledge of current schedules, procedures, and reporting requirements, is best positioned to continue without disruption.

 

Amendment No. 2 to the agreement with Terracon will increase their contract by $30,000, from $750,000 to $780,000, to support ongoing environmental consulting services for DBH projects. Terracon’s continued involvement is essential to meet California Environmental Quality Act and National Environmental Policy Act requirements and to maintain progress on these grant-funded initiatives.

 

Onboarding new consultants at this stage for either contract would significantly hinder project completion and jeopardize grant compliance.

 

On May 6, 2025 (Item No. 25), the Board approved Amendment No. 1 to Contract No 23-419 with Terracon, to increase the total contract amount by $250,000, from $500,000 to $750,000, for the continuation to provide Environmental Consulting services for projects across multiple DBH facilities.

 

Utilizing LPA. for architectural services and Terracon for environmental consulting services, respectively, has proven successful in creating cohesiveness across projects and providing continued specialized support to all the critical departments PFMD serves. The increase in contract amounts will allow these existing contractors to continue to provide services for completion of ongoing projects, based on experience and expertise specific to these projects.
