RECOMMENDATION(S)

Recommendation

Approve non-financial Memorandum of Understanding with Jamboree Housing Corporation, including a non-standard term, for the provision of health education classes, for the period of May 9, 2023 through May 8, 2024.

FINANCIAL IMPACT

This item is non-financial in nature and does not impact Discretionary General Funding (Net County Cost).  The cost of the Department of Public Health (DPH) providing the health education classes will be funded by the State of California through existing DPH grants, such as the Nutrition, Education and Obesity Prevention (NEOP) program through Cal Fresh Healthy Living, which promotes nutrition and wellness services.  

 

BACKGROUND INFORMATION

DPH has offered a variety of classes in partnership with outside agencies since 2015.  Under the terms of the recommended Memorandum of Understanding (MOU) with Jamboree Housing Corporation (Jamboree), both agencies will collaborate to provide multiple health education classes to the community to increase nutrition awareness and improve participants’ overall health and well-being.  Approval of the non-financial MOU allows for the integration of NEOP activities that promote health and well-being to low-income, eligible residents and will enhance Jamboree’s monthly food distribution program by increasing nutrition awareness in the community.

 

This partnership promotes the County’s objectives of working with other agencies with a focus on health and nutrition and meets DPH outreach objectives by educating the public on various health topics and providing resources.  Jamboree is a provider of low-income housing.  DPH will provide health education classes at Jamboree’s housing site, Sierra Fountains in Fontana once a month.  Topics include healthy food choices, quick healthy meals, healthy eating on a budget, choosing healthy beverages, and physical activity as a part of living well.

 

The MOU includes the following term that is different from the standard County contract:

 

The MOU with Jamboree includes a mutual indemnification clause.

                     The County standard contract does not include any indemnification or defense by the County for a Contractor.

                     Potential ImpactBy agreeing to indemnify Jamboree, the County could be contractually waiving the protection of sovereign immunity.  Claims that may otherwise be barred against the County, time limited, or expense limited could be brought against Jamboree without such limitations and the County would be responsible to defend and reimburse Jamboree for costs, expenses, and damage.

 

DPH recommends approval of this item, including the non-standard term, to formalize a partnership between DPH and Jamboree, to provide a variety of health education classes to the community.
