RECOMMENDATION(S)

Recommendation

1.                     Acting as the governing body of San Bernardino County, approve a joint contract between San Bernardino County, the San Bernardino County Service Areas and their Zones, and Dudek, to provide professional services for updates to the Sewer System Management Plans for Various County Departments, in an amount not-to-exceed $498,870, from November 18, 2025 to June 30, 2026, with the option to extend the term for two additional one-year periods.

2.                     Acting as the governing body of the San Bernardino County Service Areas and their Zones:

a.                     Approve a joint contract between San Bernardino County, the San Bernardino County Service Areas and their Zones, and Dudek, to provide professional services for updates to the Sewer System Management Plans for Various County Service Areas, in an amount not to exceed $498,870, from November 18, 2025 to June 30, 2026, with the option to extend the term for two additional one-year periods.

b.                     Authorize the Auditor-Controller/Treasurer/Tax Collector to post necessary budget adjustments, as detailed in the Financial Impact section, for the County Service Area 70 S-7 Lenwood Sanitation Sewer System Management Plan (Four votes required).

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). Costs associated with the recommended joint contract, which shall not exceed $498,870 for the period of November 18, 2025 through June 30, 2026, will be funded through available revenue sources of the applicable Board Governed County Service Areas and their Zones (CSAs). This contract will also be funded through County departments that have sewer systems managed by the Department of Public Works - Special Districts Water and Sanitation Division (Department).

 

The requested 2025-26 budget adjustment below is needed to cover the estimated cost associated with the Sewer System Management Plan for CSA 70 S-7 Lenwood Sanitation. The budget adjustment will be funded through the use of available Unrestricted Net Position within CSA 70 S-7 Lenwood Sanitation Fund. For all the other districts, adequate appropriations for the services have already been included in their respective 2025-26 budgets for CSAs.

BACKGROUND INFORMATION

The Department is responsible for and provides operation, maintenance and management to various County Service Areas and County wastewater collection systems pursuant to the requirements of all federal and state regulatory agencies.  The State Water Resources Control Board (SWRCB) adopted Statewide General Waste Discharge Requirements for Sanitary Sewer Systems, Water Quality Order No. 2022-0103-DWQ (Sanitary Sewer Systems General Order) on December 6, 2022 and Order No. WQ 2013-0058-EXEC (Statewide Waste Discharge Requirements for Sanitary Sewer System) on September 9, 2013, to provide consistent, statewide regulatory approach to address sanitary sewer spills and sanitary overflow.

 

The Sanitary Sewer Systems General Order requires public agencies that own or operate sanitary sewer systems to develop and implement Sewer System Management Plans (SSMPs) and report all sanitary sewer spills to the SWRCB’s online California Integrated Water Quality System (CIWQS) Sanitary Sewer System Database. As part of its duties, and to meet the SWRCB requirements, the Department is responsible for the establishment of a SSMP for each wastewater collection system greater than one mile in length.

 

The objective of the SSMP is to provide a plan and schedule to properly manage, operate and maintain all parts of the sanitary sewer system. The SSMP is established to be consistent with the following goals:

 

                     Maintain or improve the condition of the sewer collection system infrastructure to provide reliable service now and in the future;

                     Mitigate infiltration and inflow to adequately provide for sewer capacity and accommodate design storm flow; and

                     Minimize the number and impact of any sanitary sewer overflows that may occur. 

 

The updated SSMP for CSAs and County departments will meet these goals.

 

The Board of Supervisors has previously adopted Sewer System Management Plans (SSMPs) for multiple wastewater collection systems across the County, including:

 

                     November 14, 2017 (Item No. 46): Adopted SSMPs for wastewater collection systems in various CSAs and Zones.

                     December 5, 2017 (Item No. 57): Adopted the SSMP for the Glen Helen Rehabilitation Center system.

                     March 9, 2021 (Item No. 26): Adopted the SSMP for the Arrowhead Regional Medical Center system.

                     October 5, 2021 (Item No. 41): Adopted SSMPs for wastewater collection systems in various Regional Parks locations.

                     March 1, 2022 (Item No. 70): Adopted the SSMP for the Chino Airport system.

 

Under the SWRCB Sanitary Sewer Systems General Order, agencies must conduct an internal audit of their SSMPs every three years and provide an update every six years. On December 6, 2022, the SWRCB reissued the General Order, effective June 5, 2023, which extended audit and update deadlines and added new compliance criteria.

 

Approval of this item will allow Dudek to update the SSMPs to be compliant with SWRCB Order No. 2022-0103-DWQ and Order No. WQ 2013-0058-EXEC regulating statewide general waste discharge requirements for sanitary sewer systems within the new timeframes.

 

PROCUREMENT

The Department approved and authorized the release of Request for Proposal (RFP) No. SDD-069 (Bid No. SPD126-SPDAD-5992) with the Purchasing Department (Purchasing) on August 7, 2025, to solicit proposals through the County Electronic Procurement Network (e-Pro) website in accordance with formal bidding procedures established by the County. On September 11, 2025, proposals from the following consultants were received:

The evaluation panel, with representation from the Department, reviewed and evaluated the proposals based on the criteria listed in the RFP. The criteria included qualifications and experience, technical review, and references.

 

Based on the evaluation criteria, the evaluation panel found Dudek to be highest ranked and best met the needs of the CSAs and County departments. An award letter was sent on September 24, 2025, to all responsible and responsive proposers. No protests were received.
