RECOMMENDATION(S)
Recommendation
Acting as the governing body of County Service Area 70, Improvement Zone CG (Cedar Glen):
1. Authorize the submission of a financial assistance application to the State Water Resources Control Board under the Clean Water State Revolving Fund requesting an amount not-to-exceed $3,200,000 for a Cedar Glen Septic-to-Sewer System Project.
2. Adopt Resolution, as required by the State Water Resources Control Board, that:
a. Authorizes the Director of the Department of Public Works to execute and submit, for and on behalf of County Service Area 70, Improvement Zone CG (Cedar Glen), a financial assistance application for a financing agreement from the State Water Resources Control Board for planning, design, and environmental phases of the Cedar Glen Septic-to-Sewer System Project.
b. Designates the Director of the Department of Public Works to provide the assurances, certifications, and commitments required for the financial assistance application, including executing a financial assistance agreement from the State Water Resources Control Board and any amendments or changes.
c. Authorizes the Director of the Department of Public Works to represent the County Service Area 70, Improvement Zone CG (Cedar Glen) in carrying out the responsibilities under the financing agreement, including certifying disbursement requests on behalf of the County Service Area 70, Improvement Zone CG (Cedar Glen) and compliance with applicable state and federal laws.
3. Direct the Director of the Department of Public Works to transmit the financial assistance application for the Cedar Glen Septic-to-Sewer System Project to the Clerk of the Board of Supervisors within 30 days of execution.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The Department of Public Works - Special Districts (Department) is seeking financial assistance in an amount not-to-exceed $3,200,000 from the State Water Resources Control Board (SWRCB) under the Clean Water State Revolving Fund (CWSRF) for the Cedar Glen Septic-to-Sewer System Project (Project).
If the application for the Cedar Glen Septic-to-Sewer System Project, is successful, the Department will return to the Board of Supervisors (Board) for acceptance of the financial assistance award in accordance with County policy and approval of the financing agreement and any related budget adjustments. This funding opportunity does not require a local match.
BACKGROUND INFORMATION
Formation of County Service Area 70, Improvement Zone CG (Cedar Glen) (District) was approved by the Board on July 12, 2005 (Item No. 143), for the purpose of providing water and road services in the Cedar Glen area.
The District’s Project involves the design of a new sewer collection system installation and conversion from septic-to-sewer for approximately 334 developed parcels in Cedar Glen, a disadvantaged community. The new system will protect groundwater and groundwater sources within the District.
Approval of this item will authorize the submission of a financial assistance application to SWRCB under the CWSRF requesting an amount not-to-exceed $3,200,000 for the Project. The requested funding would be used for the Project’s planning, design, and environmental costs, along with the cost to prepare a separate application for the Project’s construction funding. Should the Project’s construction funding be approved in the future, then sewer collection system main lines will be installed on Cedar Glen roads to provide sewer service to the currently developed parcels, including sewer laterals to the individual dwellings/structures. The construction funding request would also include funding to abandon the individual septic tanks.
Approval of this item will also adopt a Resolution, as required by SWRCB, which authorizes the Director of the Department to take certain actions needed in relation to the grant application process and to carry out the District’s responsibilities under the sought-after financing agreement.
