RECOMMENDATION(S)

Recommendation

1.                     Approve Amendment No. 1 to Contract No. 22-434, effective July, 9, 2024, with You Go International Network, Inc. dba House of Redemption to provide housing services to adult offenders for the Probation Department, increasing the daily cost per person housed from $45 to $65 to cover cost of living increases.

2.                     Authorize the Chief Probation Officer or Assistant Chief Probation Officer to execute amendments, as needed, for future cost of living increases to the per person daily cost, subject to review by County Counsel, with no increase to the total aggregate amount of $16,000,000 for the period of July 1, 2022, through June 30, 2027, to the following agencies for the provision of housing services for adult offenders:

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funds (Net County Cost). Costs for the provision of housing services to adult offenders over the five-year period will be fully funded by State Realignment funding received under Assembly Bill (AB) 109. Adequate appropriation and revenue have been included in the Probation Department’s (Department) 2024-25 budget and will be included in future recommended budgets.

 

BACKGROUND INFORMATION

On April 4, 2011, the Governor of California signed AB 109, the Public Safety Realignment Act (Realignment). The bill created a provision for the adjudication of parole violations at the local level, rather than returning these offenders to the state prison system. Essentially, Realignment displaced responsibility for supervision of these offenders from the state to the local level.

 

Parolees are titled "Post Release Community Supervision" or PRCS offenders after their current offense is determined to be non-serious, non-violent, and non-sex related. Realignment dictates that these individuals be released for supervision to the local county where they were originally sentenced. The legislation also requires that best practices be utilized for treatment and rehabilitation.

 

Since 2013, the County has been contracting with vendors to provide housing services to adult offenders under supervision of the Department. On June 14, 2022 (Item No. 44), as the result of Request for Proposals PROB22-PROB-4436, the Board of Supervisors (Board) approved 17 contracts for housing services for a five-year period effective July 1, 2022.

 

On December 15, 2022, the Inland Empire Community Outreach Center, one of the 17 contracted agencies, contacted the Department to request an increase in the current daily rate. On February 28, 2023 (Item No. 37), the Board approved Amendment No. 1 to Contract No. 22-423 to increase the daily cost per person rate.

 

On March 19, 2024, You Go International Network, Inc. dba House of Redemption (You Go International) contacted the Department to request an increase in the current rate ($45) that is charged to house adult offenders.  The requested rate increase ($65) reflects cost of living increases. The Department considers this increase reasonably competitive relative to current market rates. Approval of the recommended amendment would allow You Go International to continue to provide housing services to adult offenders.

 

Due to nationwide cost of living increases, the Department foresees that other agencies might be requesting increases in the daily per person rate.

 

Approval of Recommendation No. 2 will allow the Chief Probation Officer or Assistant Chief Probation Officer to execute amendments to the contracts, as needed, with no change to the aggregate amount of $16,000,000, upon County Counsel review.
