Recommendation
Approve non-financial Agreement (State Agreement No. 25-6) with the California Department of Public Health, Office of AIDS that sets forth the information privacy and security requirements of protected data effective upon execution by both parties, for a five-year period.

BACKGROUND INFORMATION
The California Department of Public Health (CDPH) requires the County Department of Public Health (DPH) to enter into the California HIV/AIDS Case Reporting System, Data Use and Disclosure Agreement (Agreement), which details privacy and security requirements of protected data entered or received from the HIV/AIDS Case Reporting System (System). The System is a nationwide database allowing providers to enter patient information regarding HIV and AIDS, and to provide local health jurisdictions the ability to identify, engage, and provide treatment to HIV/AIDS positive individuals in their area.
San Bernardino County has had active data use agreements with the CDPH Office of AIDS since 2010, with new Agreements executed approximately every five years. The recommended Agreement specifies the security and confidentiality conditions under which DPH can send, receive, or download HIV/AIDS data.
Quarterly data downloads are used by DPH to identify individuals reported as HIV positive so DPH can engage patients in treatment, if an individual with HIV has been reclassified as having AIDS, or to record dates of death. The information in the data download is also used to generate data reports and to support DPH’s Ryan White grants Parts A, B, and C.
This Agreement will supersede Agreement No. 19-511 (State Agreement No. 25-5), dated August 22, 2019, between CDPH and DPH, which expires August 22, 2024. This agreement will be for a five-year period effective upon execution by both parties.
