RECOMMENDATION(S)
Recommendation
1. Approve Grant Award Agreement (Grant Award Agreement No. B-24-CP-CA-0379), including non-standard terms, with the United States Department of Housing and Urban Development for the Tent Campground Restroom and Shower Facility Project at Prado Regional Park, in an amount not to exceed $850,000, with a required period of performance of August 13, 2024 through August 31, 2032.
2. Authorize the Chair of the Board of Supervisors or Chief Executive Officer to approve and execute any subsequent non-substantive amendments to the Grant Award Agreement with the United States Department of Housing and Urban Development for the Tent Campground Restroom and Shower Facility Project at Prado Regional Park, subject to County Counsel review.
3. Direct the Director of the Regional Parks Department to transmit any subsequent non-substantive amendments to the Grant Award Agreement to the Clerk of the Board of Supervisors within 30 days following execution.

FINANCIAL IMPACT
Approval of this Grant Award Agreement (Grant Award Agreement No. B-24-CP-CA-0379) (Agreement) will not result in the use of Discretionary General Funding (Net County Cost). If approved, this grant award will partially fund the Tent Campground Restroom and Shower Facility Project (Project) at Prado Regional Park (Park), in an amount not to exceed $850,000. This award does not require any matching funds.
BACKGROUND INFORMATION
The United States Department of Housing and Urban Development (HUD) Office of Community Planning and Development, Congressional Grants Division is responsible for the administration of congressionally directed spending under the Economic Development Initiative - Community Project Funding (CPF). CPF grants provide investment in a wide variety of projects such as housing, homelessness prevention, workforce training, public facilities, parks, resilience planning and other critical infrastructure and services. The Regional Parks Department (Department) submitted a request to Congresswoman Norma Torres’ office for the Project.
On August 29, 2024, the Department received notification from the CPF administration stating that the Project had been funded pending execution of the Agreement. The Agreement required a National Environmental Policy Act (NEPA), assessment completion before execution. NEPA was completed and received by the Department on May 20, 2025, allowing the Department to bring the agreement to the Board. Approval of this item will allow the Department to move forward with execution of the Agreement and starting the Project, subject to the conditions and confirmation that all federal requirements, including, but not limited to, environmental analysis and review, labor, reporting, procurement and contracting have been met. HUD provided a project initiation date of August 13th, 2024, requiring this Agreement to be signed dating back to HUD’s indicated Agreement start date.
The Project will consist of assessment and renovation/replacement of the existing tent campground restroom and shower facility to provide accessibility to residents and visitors to enjoy the outdoors safely.
The Agreement with HUD is non-negotiable and includes the following non-standard contract terms:
1. There is no termination for convenience.
• The County standard contract gives the County the right to terminate the contract, for any reason, with a 30-day written notice of termination.
• Potential Impact: The County does not have the ability to terminate this Agreement for convenience and is bound to the terms of this Agreement.
2. The performance term ends on August 31, 2032.
• The County standard contract term is for five years.
• Potential Impact: The HUD period of performance for this Agreement is more than five years and runs through August 31, 2032.
The Department recommends approval of the Agreement, including the non-standard terms, as this Project aligns with the County and the Chief Executive Officer’s goals and objectives to promote the countywide vision and ensures the development of a well-planned, balanced, and sustainable County through the renovation/replacement of the existing tent campground restroom and shower facility for the public’s use and enjoyment.
PROCUREMENT
Upon approval of the Project, PFMD will determine whether the design and construction services may be procured through the use of an existing Board-approved Consultant Services Contract for design and a Job Order Contract (JOC) for construction, or if not applicable under a JOC, a competitive selection process following local and federal procurement and California Public Contract Code requirements will be conducted for construction.
