RECOMMENDATION(S)
Recommendation
1. Approve Contract with San Bernardino City Unified School District to contribute funding towards field lighting installation costs at Paakuma K-8, in an amount not-to-exceed $1,100,000, for the period of December 19, 2023, through December 12, 2025.
2. Approve Contract with the San Bernardino Police Foundation to provide funding to purchase two utility terrain vehicles and six electric bicycles for the City of San Bernardino Police Department, including necessary accessories, in an amount not-to-exceed $120,000, for the period of December 19, 2023, through December 18, 2024.
3. Approve Contract with the City of Rialto to provide funding to purchase a specialized medium-duty truck, including necessary accessories, in an amount not-to-exceed $150,000, for the period of December 19, 2023, through December 18, 2024.
4. Approve Amendment No. 2 to Contract No. 23-72 with Provisional Educational Services Inc., dba The PAL Center and PAL Center Academy for the PAL Ballfield at Blake Park Rehabilitation Project to revise the scope of work, with no change in the not-to-exceed amount of $2,100,000 or term of February 7, 2023, through August 6, 2024.
5. Approve Contract with the Boys & Girls Club of Fontana to assist with costs towards the purchase and installation of outdoor flood lights, wireless security systems, concrete repairs, and replacement of landscape and irrigation systems at identified Boys & Girls Club of Fontana Clubhouses, reallocating remaining funds previously awarded under Contract No. 22-89 in the not-to-exceed amount of $200,000, retroactively effective for the period February 8, 2022, through December 31, 2024.

FINANCIAL IMPACT
Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). On September 21, 2021 (Item No. 18) and November 16, 2021 (Item No. 33), the Board of Supervisors (Board) approved an allocation of $4 million and $7 million, respectively, to the Board Discretionary Fund - District Specific Priorities Program (Priorities Program), for each of the five supervisorial districts for projects that meet a public purpose, and provide services to citizens that promote health, safety, economic well-being, and other public services that enhance quality of life and meet the needs of County residents. On an annual basis, unspent appropriations for discretionary funding will be carried over into the subsequent year’s budget. Recommendation Nos. 1, 2 and 3 will be funded by the Fifth District’s Priorities Program budget. Funds from Contract No. 23-72, which was approved by the Board on February 7, 2023 (Item 17), have been funded by the Fifth District’s Priorities Program budget. Funds from Contract No. 22-89, which was approved by the Board on February 8, 2022 (Item No. 30), have been funded by the Second District’s Priorities Program budget, will be reallocated to the contract in Recommendation No. 5.
BACKGROUND INFORMATION
Priorities Program projects help promote the vision of a complete County by recognizing the unique traits of each Supervisorial District and, thereby, allow individual Board Districts to work with community partners through County services and contractual agreements to identify programs, projects, and initiatives that support the vision, meet a public purpose and provide services to residents that promote health, safety, economic well-being, education, recreation, and other public services that enhance quality of life, and meet the needs of the County’s residents. Projects under the District Specific Priorities Program are based on District Supervisor discretion and are presented by the Chief Executive Officer (CEO) for Board approval.
Recommendation No. 1 assists the Fifth District Supervisor in supporting County residents by providing funding towards field lighting installation costs at the Paakuma K-8 school. This project serves the public purpose of providing for the social, educational, recreational, public health, and economic needs of County residents while at the same time expanding the use of use of Paakuma K-8 athletic fields, enhance accessibility, and benefit youth sports.
Recommendation No. 2 assists the Fifth District Supervisor with the public purpose of providing for the health, public safety, and law enforcement needs of County residents by providing funding to the San Bernardino Police Foundation for the purchase of two utility terrain vehicles (UTV) and six electric bicycles for the City of San Bernardino Police Department. The UTV’s and bicycles assist law enforcement with the patrolling of large events in vast areas unable to be accessed with standard vehicles, increase response times, and enforcement of crimes.
Recommendation No. 3 assists the Fifth District Supervisor with the public purpose of providing for the health, public safety, and emergency response needs of County residents by providing funding to the City of Rialto to purchase a specialized medium-duty truck, including necessary accessories, rescue tools, communication equipment, lights, sirens, and identifying decals for each public safety department. The specialized vehicle assists the fire department to enhance and support the California Fire Service and Rescue Mutual Aid Plan (Plan) by significantly bolstering the department's ability to effectively participate in and contribute to the statewide fire/rescue master mutual aid system. The Plan is a comprehensive system organized under the California Office of Emergency Services, designed to manage and mitigate emergencies, especially wildfires, that exceed local response capabilities.
On February 7, 2023 (Item No. 17), the Board approved Contract No. 23-72 with Provisional Educational Services Inc., dba The PAL Center and PAL Center Academy (PAL Center) to construct the PAL Ballfield at Blake Park Rehabilitation Project, for a not-to-exceed amount of $2,100,000 for the term of February 7, 2023, through February 6, 2024. The Project improvements include renovating the ballfield, dugouts, bleachers, restrooms, and scoreboard, with other optional improvements subject to availability of funds. On December 12, 2023, the CEO approved Amendment No. 1 to the contract to authorize the contractor’s request to extend the contract by an additional six months, from February 6, 2024, to August 6, 2024. Approval of Recommendation No. 4 will continue to assist the Fifth District Supervisor with the public purpose of providing for the recreational, health, rehabilitation and social service needs of County residents by amending the contract to allow for the renovation and rehabilitation of the existing snack bar and restroom building to be included in the Project scope of work as an optional item. Previously, the scope of work only allowed for the demolition and installation of a prefabricated restroom unit. This change will provide additional flexibility for the Project, subject to the availability of funds. No additional funding in excess of the $2,100,000 previously allocated under Contract No. 23-72 is being allocated to the PAL Center.
On February 8, 2022 (Item No. 30), the Board approved Contract No. 22-89 in the amount of $200,000 with the Boys & Girls Club of Fontana to assist with purchase and installation of outdoor flood lights and wireless security systems at identified Boys & Girls Club of Fontana Clubhouses. However due to logistical delays, the Boys & Girls Club of Fontana has been unable to purchase and install all needed outdoor flood lights and wireless security systems. Contract No. 22-89 expired on August 31, 2022. To ensure all purchases made to date by the Boys & Girls Club of Fontana are allowable, the District is requesting approval of this new contract retroactively to February 8, 2022. Approval of Recommendation No. 5 will continue to assist the Second District Supervisor with promoting the public purposes of providing for the health, safety, educational and social service needs of County residents by allowing the Boys & Girls Club of Fontana additional time to purchase and install the needed outdoor flood lights and wireless security systems and update the scope of work to include concrete repairs, and the replacement of landscape and irrigation systems at identified Boys & Girls Club of Fontana Clubhouses. No additional funding in excess of the $200,000 previously allocated under Contract No. 22-89 is being allocated to the Boys & Girls Club of Fontana under this new contract for the improvements at identified Boys & Girls Club of Fontana Clubhouses.
Under the contract terms, the CEO, at the direction of the identified Supervisor, may extend the term of the contract, in writing, under the following conditions:
a. In aggregate all extensions do not exceed 12 calendar months;
b. Is specifically requested by the contractor;
c. Will not change the project goals or scope of services;
d. Is in the best interest of the County and contractor in performing the scope of services under the contract; and
e. Does not alter the amount of compensation under the contract.
Board discretionary funding allocations under the Priorities Program are non-competitive and must be for projects or services of $50,000 or more. Contracts shall be paid on a lump-sum basis or under other terms as approved by the Board.
